Amending O. Reg. 286/01

(BENEFIT PLANS)

1. (1) The definition of “pension plan” in section 1 of Ontario Regulation 286/01 is amended by striking out “and” at the end of clause (d), by adding “and” at the end of clause (e) and by adding the following clause:

(f) a pooled registered pension plan;

(2) Section 1 of the Regulation is amended by adding the following definition:

“pooled registered pension plan” has the same meaning as in the Pooled Registered Pension Plans Act, 2015; (“régime de pension agréé collectif”)

2. Section 4 of the Regulation is amended by adding the following subsection:

(4) The prohibition in subsection 44 (1) of the Act does not apply with respect to a differentiation because of age in the following, provided that the differentiation is in accordance with the Pooled Registered Pension Plans Act (Canada), as it applies for the purposes of the Pooled Registered Pension Plans Act, 2015:

1. In a provision of a pooled registered pension plan.

2. In the administration of a pooled registered pension plan.

3. In the administration of a retirement savings plan prescribed under the Pooled Registered Pension Plans Act (Canada), as it applies for the purposes of the Pooled Registered Pension Plans Act, 2015.

Commencement

3. This Regulation comes into force on the later of January 1, 2018 and the day it is filed.
