Amending O. Reg. 222/98

(GENERAL)

1. The definition of “dependant” in subsection 1 (1) of Ontario Regulation 222/98 is amended by striking out “or” at the end of subclause (a) (iii), by adding “or” at the end of clause (b) and by adding the following clause:

(c) a dependent child who is absent from the dwelling place of the applicant or recipient as a result of the involvement of a children’s aid society and the absence is expected to be temporary;

2. Subsection 2 (3) of the Regulation is amended by adding “and” at the end of clause (b), by striking out “and” at the end of clause (c) and by revoking clause (d).

3. (1) Subsection 4 (1) of the Regulation is amended by adding the following paragraphs:

5.1 Former residents of a home for special care established, licensed or approved under the Homes for Special Care Act if they were residents of the home at any time on or after January 1, 2018.

5.2 Residents and former residents of homes that are part of the program of the Ministry of Health and Long-Term Care known as Community Homes for Opportunity.

(2) Subsection 4 (2) of the Regulation is revoked.

4. Subsection 17 (2) of the Regulation is revoked.

5. (1) Subsection 19 (1) of the Regulation is amended by striking out “former recipient” wherever it appears and substituting in each case “former applicant or former recipient”.

(2) Subsection 19 (3) of the Regulation is revoked and the following substituted:

(3) A previous determination that is relied upon for the purposes of a new application under subsection (1) shall be subject to a review if a review date was set for the previous determination under section 5 and the review has not yet occurred at the time the former applicant or former recipient reapplies for income support.

(3) Clause 19 (4) (a) of the Regulation is amended by striking out “the former recipient is re-instated” and substituting “the former applicant or former recipient reapplies”.

6. Section 20 of the Regulation is revoked.

7. Section 29.1 of the Regulation is revoked.

8. Section 36.2 of the Regulation is amended by adding the following subsection:

(6) In the case of a retroactive payment that applies to a period after June 30, 2016, item “D” in the formula set out in subsection (2) shall equal the total payment with respect to dependent children that would have been made with respect to item “C” in the formula set out in subsection 122.61 (1) of the Income Tax Act (Canada), as if that subsection, as it read on July 1, 2016, applied.

9. Subparagraph 1 v of subsection 38 (1) of the Regulation is amended by striking out “$300” in the portion before sub-subparagraph A and substituting “$1,000”.

10. Paragraph 10.1 of subsection 41 (1) of the Regulation is revoked.

11. Section 42 of the Regulation is amended by adding the following paragraph:

4.2 A disabled contributor’s child’s benefit payment under the Canada Pension Plan.

12. (1) Paragraph 7 of subsection 43 (1) of the Regulation is amended by striking out “Subject to subsection (4)” at the beginning.

(2) Subsection 43 (1) of the Regulation is amended by adding the following paragraph:

37. A disabled contributor’s child’s pension payment under the Act Respecting the Quebec Pension Plan (Quebec).

(3) Subsection 43 (1) of the Regulation is amended by adding the following paragraph:

38. A fee or allowance paid for attendance as a juror.

(4) Subsection 43 (4) of the Regulation is revoked.

13. Subsection 44 (1.0.0.0.1) of the Regulation is revoked.

14. Section 45.3 of the Regulation is amended by adding the following subsection:

(5) When calculating a transition child benefit payment that applies to a period after June 30, 2016, a reference to an amount in respect of item “C” in the formula set out in subsection 122.61 (1) of the Income Tax Act (Canada) shall be read as an amount that would have been determined in respect of item “C” in the formula set out in that subsection as if that subsection, as it read on July 1, 2016, applied.

15. Paragraph 4 of subsection 46 (1) of the Regulation is revoked and the following substituted:

4. A registered nurse who is a member of the College of Nurses of Ontario.

16. Clause 51 (1) (b) of the Regulation is revoked and the following substituted:

(b) 100 per cent of any arrears of income support under the Act or assistance under the Ontario Works Act, 1997 payable to the recipient.

17. Paragraphs 7, 8 and 9 of section 57 of the Regulation are revoked.

Commencement

18. (1) Subject to subsections (2), (3), (4) and (5), this Regulation comes into force on the day it is filed.

(2) Subsection 3 (2), sections 5, 6 and 9 and subsections 12 (1), (3) and (4) are deemed to have come into force on September 1, 2017.

(3) Section 11 and subsection 12 (2) are deemed to have come into force on October 1, 2017.

(4) Section 15 comes into force on January 15, 2018.

(5) Section 2 comes into force on February 1, 2018.
