Immediate Medical Care
Definition
1. For the purposes of subsection 15 (7) of the Act and this Regulation,
“immediate medical care” means emergency first aid assistance provided by an official, including the administration of naloxone, to an affected person who requires or appears to require emergency first aid assistance, if the assistance is provided,
(a) immediately after the official arrives at the scene of an incident, or
(b) after arriving at the scene of an incident, immediately after the official becomes aware of the need or apparent need for emergency first aid assistance.
No investigation if immediate medical care
2. The SIU Director shall not investigate an incident in which an official provided immediate medical care to the affected person in the incident if the SIU Director determines that the immediate medical care was provided in the following circumstances:
1. There was no use of force against the affected person by any official before or after the immediate medical care was provided.
2. The affected person was not under arrest, detained or otherwise in the custody of any official immediately before or after the immediate medical care was provided.
3. No official caused or contributed to the need or apparent need for immediate medical care.
4. The need or apparent need for immediate medical care did not arise as a result of an accident or other emergency involving a motor vehicle driven by any official or involving pursuit by any official in a motor vehicle.
Commencement
3. This Regulation comes into force on the later of the day clause 39 (2) (d) of Schedule 4 to the Safer Ontario Act, 2018 comes into force and the day this Regulation is filed.
