Amending O. Reg. 321/09

(GENERAL MOTORS PENSION PLANS)

1. Ontario Regulation 321/09 is amended by striking out “Superintendent” wherever it appears in the following provisions and substituting in each case “Chief Executive Officer”:

1. Subsections 2 (3).

2. Subsection 5 (6).

3. Subsection 16 (1).

2. Section 2 of the Regulation is amended by adding the following subsection:

(4) For the purposes of subsection (3), a report filed with the Superintendent under this Regulation or under section 3 or 14 of the General Regulation, as they read prior to the day section 1 of Schedule 23 to the Plan for Care and Opportunity Act (Budget Measures), 2018 came into force, is deemed to have been filed with the Chief Executive Officer.

3. Section 5 of the Regulation is amended by adding the following subsection:

(9) For the purposes of subsection (6), a report filed with the Superintendent under section 14 of the General Regulation, as it read prior to the day section 1 of Schedule 23 to the Plan for Care and Opportunity Act (Budget Measures), 2018 came into force, is deemed to have been filed with the Chief Executive Officer.

4. Section 16 of the Regulation is amended by adding the following subsection:

(4) For the purposes of subsection (1),

(a) an election filed with the Superintendent prior to the day section 1 of Schedule 23 to the Plan for Care and Opportunity Act (Budget Measures), 2018 came into force, is deemed to have been filed with the Chief Executive Officer; and

(b) a report filed with the Superintendent under section 14 of the General Regulation, as it read prior to the day section 1 of Schedule 23 to the Plan for Care and Opportunity Act (Budget Measures), 2018 came into force, is deemed to have been filed with the Chief Executive Officer.

Commencement

5. This Regulation comes into force on the later of the day section 1 of Schedule 23 to the Plan for Care and Opportunity Act (Budget Measures), 2018 comes into force and the day this Regulation is filed.
