Amending Reg. 851 of R.R.O. 1990

(INDUSTRIAL ESTABLISHMENTS)

1. The heading immediately before section 2 of Regulation 851 of the Revised Regulations of Ontario, 1990 is revoked and the following substituted:

2. Section 2 of the Regulation is revoked and the following substituted:

2. An employer, owner or constructor may vary a procedure required by this Regulation or the composition, design, size or arrangement of a material, object, device or thing as required by this Regulation,

(a) if the procedure, composition, design, size or arrangement as varied affords protection for the health and safety of workers that is at least equal to the protection that would otherwise be given; and

(b) if the employer, owner or constructor gives written notice of the varied procedure, composition, design, size or arrangement to the joint health and safety committee or the health and safety representative, if any, for the workplace and to any trade union representing workers at the workplace.

3. Section 42.2 of the Regulation is amended by striking out “2014” at the end and substituting “2019”.

4. Section 86 of the Regulation is revoked and the following substituted:

86. Where a worker is exposed to the hazard of falling into liquid that is of sufficient depth for a life jacket or other personal flotation device to be effective as protection from the risk of drowning, there shall be an alarm system and rescue equipment, appropriate in the circumstances, to ensure the worker’s rescue from the liquid and,

(a) the worker shall wear a life jacket or other personal flotation device that is appropriate in the circumstances; or

(b) the employer shall develop and implement written measures and procedures to prevent the worker from drowning.

5. The definition of “registered” in subsection 104 (2) of the Regulation is amended by striking out “Ministry of Advanced Education and Skills Development” and substituting “Ministry of Training, Colleges and Universities”.

6. (1) Subsection 105 (1) of the Regulation is amended by striking out “Ministry of Advanced Education and Skills Development” in the portion before paragraph 1 and substituting “Ministry of Training, Colleges and Universities”.

(2) Subsection 105 (2) of the Regulation is amended by striking out “Ministry of Advanced Education and Skills Development” and substituting “Ministry of Training, Colleges and Universities”.

7. Sections 124 and 125 of the Regulation are revoked and the following substituted:

124. (1) Where a worker is required to work with, or is likely to be exposed to, a hazardous biological or chemical agent that could cause injury to the eye or skin, an employer shall provide as many of the following as are needed for adequate emergency treatment:

1. Eye wash facilities.

2. Emergency showers.

3. Antidotes, flushing fluids or washes.

(2) The emergency equipment or treatments described in subsection (1) must,

(a) be clearly marked with a sign or label;

(b) be located or installed in a conspicuous place near where the hazardous biological or chemical agent is kept or used;

(c) be readily accessible to workers; and

(d) have instructions for its use displayed on the equipment or treatment or as near to it as is practical.

Commencement

8. This Regulation comes into force on the later of July 1, 2019 and the day it is filed.
