ORDER UNDER SUBSECTION 7.0.2 (4) OF THE ACT - USE OF FORCE AND FIREARMS IN POLICing Services

Whereas an emergency was declared pursuant to Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 at 7:30 a.m. Toronto time pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act (the “Act”) and has been extended pursuant to section 7.0.7 of the Act;

And Whereas the criteria set out in subsection 7.0.2 (2) of the Act have been satisfied;

Now Therefore, this Order is made pursuant to subsection 7.0.2 (4) of the Act, in particular paragraphs 9, 12, and 14 of that subsection, the terms of which are set out in Schedule 1;

And Further, this Order applies generally throughout Ontario;

And Further, this Order shall be in effect for the duration of the declared emergency, subject to section 7.0.8 of the Act.

SCHEDULE 1
USE OF FORCE AND FIREARMS IN POLICING SERVICES

Application

1. This Order applies to police forces within the meaning of the Police Services Act and police services in which policing is delivered by First Nations Constables appointed pursuant to subsection 54 (1) of the Police Services Act.

Use of force

2. Despite any other statute, regulation, order, policy, arrangement or agreement, including a collective agreement, chiefs of police of police forces or police services mentioned in section 1 may authorize police officers, First Nations Constables or special constables to perform duties involving the use of force if they successfully completed the training course on the use of force referred to in subsection 14.2 (1) of Regulation 926 of the Revised Regulations of Ontario, 1990 (Equipment and Use of Force) made under the Police Services Act within the 24-month period before the authorization is made.

Use of firearms

3. Despite any other statute, regulation, order, policy, arrangement or agreement, including a collective agreement, chiefs of police of police forces or police services mentioned in section 1 may authorize police officers or First Nations Constables to carry a firearm if they successfully completed the training course on the use of firearms referred to in subsection 14.2 (2) of Regulation 926 of the Revised Regulations of Ontario, 1990 (Equipment and Use of Force) made under the Police Services Act within the 24-month period before the authorization is made.

Authorization

4. A chief of police’s authorization under section 2 or 3 remains in effect as long as this Order is in effect, unless the chief of police revokes the authorization earlier.
