Amending Reg. 761 of R.R.O. 1990

(MILK AND MILK PRODUCTS)

1. Regulation 761 of the Revised Regulations of Ontario, 1990 is amended by adding the following section:

Extension of Certificates and Licences Due to Coronavirus (Covid-19)

125.1 (1) In this section,

“certificate” means a milk and cream grader’s certificate or a bulk tank milk grader’s certificate issued under section 89; (“certificat”)

“emergency” means the emergency declared by the Lieutenant Governor in Council on March 17, 2020 under section 7.0.1 of the Emergency Management and Civil Protection Act in the whole of the Province of Ontario as a result of the outbreak of the coronavirus (COVID-19); (“situation d’urgence”)

“emergency period” means the period during which the emergency is in effect and includes the period of any extension of that emergency made under section 7.0.7 of the Emergency Management and Civil Protection Act. (“période de situation d’urgence”)

(2) A certificate that expired on March 31, 2020 is deemed to have been renewed as of the day this section comes into force and shall continue in effect, subject to subsection (6).

(3) A licence to carry on business as a non-shopkeeper-distributor that expired on March 31, 2020 is deemed to have been renewed as of the day this section comes into force and shall continue in effect, subject to subsection (6).

(4) Despite subsections 88 (3) and 114 (5), any certificate or licence to carry on business as a non-shopkeeper-distributor that, but for this subsection, would expire on or after the day this section comes into force but before the end of the emergency period shall not expire on that day but shall continue in effect, subject to subsection (6).

(5) Despite subsection 96 (3), any licence to operate a plant that, but for this subsection, would expire on June 30, 2020 shall not expire on that day but shall continue in effect, subject to subsection (6).

(6) A certificate or licence that is deemed to have been renewed under subsection (2) or (3) or that is continued under subsection (4) or (5) shall expire 90 days after the end of the emergency period.

(7) Despite subsections 88 (3) and 114 (5), any certificate or licence to carry on business as a non-shopkeeper-distributor that, but for this subsection, would expire on a day that is within 60 days after the end of the emergency period shall not expire on that day but shall continue in effect, subject to subsection (8).

(8) A certificate or licence that is continued under subsection (7) shall expire 90 days after the day it would have expired but for subsection (7).


Commencement

2. This Regulation comes into force on the day it is filed.
