Amending O. Reg. 429/04

(ADJUSTMENTS UNDER SECTION 25.33 OF THE ACT)

1. (1) Part III of Ontario Regulation 429/04 is amended by adding the following section:

Applicable base period for 2021-2022 adjustment period

19.2 (1) Despite anything to the contrary in this Part, a base period of May 1, 2019 to April 30, 2020 shall be used for the purposes of determining the peak demand factor for the adjustment period commencing in 2021 in respect of a person or other entity that is a Class A market participant, deemed Class A market participant, Class A consumer or deemed Class A consumer at any time during the adjustment period commencing in 2020.

(2) For the purposes of this section, the peak demand factor for the adjustment period commencing in 2021 of a licensed distributor who is a market participant is, despite subsection 11 (5) and subject to subsection (3), the amount calculated to eight decimal places using the formula,

(X1/W1) + (X2/W2)

in which,

“X1”  is the total volume of electricity distributed during the peak hours in the base period referred to in subsection (1) to those Class A consumers to whom that subsection applies by the licensed distributor or by a wholly-embedded distributor of which the licensed distributor is the host distributor,

“W1” is “W” as defined in subsection 11 (4), as applied in respect of the base period referred to in subsection (1),

“X2”  is the total volume of electricity distributed during the peak hours in the base period commencing in 2020 to those Class A consumers to whom subsection (1) does not apply by the licensed distributor or by a wholly-embedded distributor of which the licensed distributor is the host distributor, and

“W2” is “W” as defined in subsection 11 (4), as applied in respect of the base period commencing in 2020.

(3) Despite subsection 11 (5.1), if a licensed distributor who is a market participant distributes electricity to Class A consumers who are eligible cogeneration customers in respect of the adjustment period commencing in 2021, the peak demand factor of the licensed distributor for the adjustment period is the amount calculated to eight decimal places using the formula,

((X1 – X.1.1) /W1) + ((X2 – X.1.2) /W2)

in which,

“X1”  is the total volume of electricity distributed during the peak hours in the base period referred to in subsection (1) to those Class A consumers to whom that subsection applies by the licensed distributor or by a wholly-embedded distributor of which the licensed distributor is the host distributor,

“X.1.1”  is “X.1” as defined in subsection 11 (5.1), as applied in respect of the base period referred to in subsection (1),

“W1” is “W” as defined in subsection 11 (4), as applied in respect of the base period referred to in subsection (1),

“X2”  is the total volume of electricity distributed during the peak hours in the base period commencing in 2020 to those Class A consumers to whom subsection (1) does not apply by the licensed distributor or by a wholly-embedded distributor of which the licensed distributor is the host distributor,

“X.1.2”is “X.1” as defined in subsection 11 (5.1), as applied in respect of the base period commencing in 2020, and

“W2” is “W” as defined in subsection 11 (4), as applied in respect of the base period commencing in 2020.

(4) For the purposes of the definitions of “X.1.1” and “X.1.2” as regards the application of subsection 11 (5.2),

(a)  a reference in that subsection to “X.1” shall be read as a reference to “X.1.1” or “X.1.2”, as the case may be; and

(b)  a reference in that subsection to “X” shall be read as a reference to “X1” or “X2”, as the case may be.

(5) For the purposes of this section, the peak demand factor of a wholly-embedded distributor for the adjustment period commencing in 2021 is, despite subsection 12 (3), the amount calculated to eight decimal places using the formula,

(BB1/W1) + (BB2/W2)

in which,

“BB1” is the total volume of electricity distributed by the wholly-embedded distributor during the peak hours in the base period referred to in subsection (1) to those Class A consumers to whom that subsection applies,

“W1” is “W” as defined in subsection 11 (4), as applied in respect of the base period referred to in subsection (1),

“BB2” is the total volume of electricity distributed by the wholly-embedded distributor during the peak hours in the base period commencing in 2020 to those Class A consumers to whom subsection (1) does not apply, and

“W2” is “W” as defined in subsection 11 (4), as applied in respect of the base period commencing in 2020.

(2) Section 19.2 of the Regulation, as made by subsection (1), is revoked.

Commencement

2. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Subsection 1 (2) comes into force on the later of July 1, 2022 and the day this Regulation is filed.
