Amending O. Reg. 667/98

(TRAPPING)

1. The definition of “registered trapline area” in subsection 1 (1) of Ontario Regulation 667/98 is amended by striking out “Director of Species Conservation Policy Branch” and substituting “Director of the Fish and Wildlife Policy Branch”.

2. (1) Subsection 15 (1) of the Regulation is revoked.

(2) Subsection 15 (3) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(3) Despite subsection (2), a person referred to in that subsection may be issued a licence referred to in that subsection if the Director of the Fish and Wildlife Policy Branch of the Ministry is of the opinion that,

3. The Regulation is amended by adding the following section:

27.1 (1) Subject to subsection (2),

(a)  the holder of a trapping licence is exempt from subsection 20 (1) of the Act for the purposes of killing, during the period from half an hour after sunset to half an hour before sunrise, a furbearing mammal that has been lawfully trapped by the person; and

(b)  a farmer, and a member of the farmer’s family who resides with the farmer, are exempt from subsection 20 (1) of the Act for the purposes of killing, during the period from half an hour after sunset to half an hour before sunrise, a furbearing mammal that has been lawfully trapped on the farmer’s land in accordance with subsection 6 (3) of the Act.

(2) An exemption under subsection (1) does not apply to a person referred to in that subsection unless the person complies with all of the following conditions:

1.  The only firearm that the person may use to kill a furbearing mammal is a rim-fire rifle.

2.  The only firearm that the person may have un-encased and loaded is a rim-fire rifle, subject to paragraphs 3 and 4.

3.  The person shall keep the rim-fire rifle encased and unloaded until the person is in the immediate vicinity of the furbearing mammal that the person has lawfully trapped.

4.  The person shall unload and encase the rim-fire rifle immediately after the furbearing mammal has been killed.

Commencement

4. This Regulation comes into force on the later of January 1, 2021 and the day it is filed.
