Amending Reg. 682 of R.R.O. 1990

(LABORATORIES)

1. Section 1 of Regulation 682 of the Revised Regulations of Ontario, 1990 is amended by adding the following definition:

“point-of-care testing” means testing performed outside a clinical laboratory at or near where a patient is receiving care; (“analyse hors laboratoire”)

2. Section 4 of the Regulation is amended by adding the following subsection:

(2.1) A laboratory is exempt from the condition in paragraph 3 of subsection (1) for the purpose of providing point-of-care testing for COVID-19, subject to the following:

1. Any requirements under the Act and any conditions or restrictions to which a laboratory’s licence is subject apply, with necessary modifications, with respect to a location where the laboratory is providing point-of-care testing for COVID-19.

2. No specimen collection may be carried out in a location where a licensed laboratory is performing point-of-care testing, other than specimen collection in relation to COVID-19.

3. Section 8 of the Regulation is amended by adding the following subsection:

(3) Subsections (1) and (2) do not apply in respect of point-of-care testing for COVID-19.

4. Subclause 9 (1) (a) (vii) of the Regulation is amended by striking out “a polymerase chain reaction test” and substituting “a test”.

5. The Regulation is amended by adding the following section:

13.2 The following persons are exempt from sections 5 to 16 of the Act and from the provisions of this Regulation with respect to performing a point-of-care test that is in relation to COVID-19 only:

1. A legally qualified medical practitioner.

2. A registered practical nurse or registered nurse, including a registered nurse who holds an extended certificate of registration under the Nursing Act, 1991.

3. A person registered as a dentist under the Dentistry Act, 1991.

4. A person registered as a pharmacist under the Pharmacy Act,1991.

5. A paramedic in the course of their employment with an ambulance service operator that is certified under the Ambulance Act.

6. A person who provides services as part of a community paramedicine program approved by either the Ministry of Health or Ministry of Long-Term Care, and who is a paramedic within the meaning of the Ambulance Act.

Commencement

6. This Regulation comes into force on the day it is filed.
