Amending O. Reg. 489/20

(GRANTS FOR STUDENT NEEDS - LEGISLATIVE GRANTS FOR THE 2020-2021 SCHOOL BOARD FISCAL YEAR)

1. The definition of “capital asset cost” in subsection 2 (1) of Ontario Regulation 489/20 is amended by striking out “April 2020” and substituting “January 2021”.

2. Paragraph 1 of subsection 9 (1) of the Regulation is amended by striking out “April 2020” and substituting “January 2021”.

3. Subsection 14 (1) of the Regulation is amended by adding the following paragraph:

1.1  Add the amount of the board’s funding stabilization allocation determined under section 69.1.

1.2  Add the amount of the board’s adjustment for declining enrolment for the current fiscal year.

4. (1) The formula in subsection 15 (1) of the Regulation is revoked and the following substituted:

(A + B + C) - (D + E + F)

(2) Definitions “C”, “D” and “E” in subsection 15 (1) of the Regulation are revoked and the following substituted:

  “C”  is the amount of the board’s funding stabilization allocation determined under section 69.1,

  “D”  is the amount of the board’s tax revenue for the current fiscal year, as determined in this Regulation,

  “E”  is the amount of the board’s total fees revenue for the current fiscal year in respect of pupils described in section 4 of the current fiscal year’s fees regulation, as determined under that section, and

“F”  is the amount of the board’s expenses that are not incurred in the current fiscal year by reason of a strike or lock-out affecting the operations of the board, calculated in accordance with Ontario Regulation 486/98 (Board Expenses Not Incurred by Reason of Strike or Lock-Out) made under the Act.

5. Subsection 55 (2) of the Regulation is amended by striking out “April 2020” and substituting “January 2021”.

6. Subsection 66 (2) of the Regulation is amended by striking out “May 2019” at the end and substituting “January 2021”.

7. The Regulation is amended by adding the following section:

Funding Stabilization Allocation

Funding stabilization allocation

69.1 A district school board’s funding stabilization allocation is the amount determined as follows:

1.  Determine the total of the board’s grant allocations, excluding the debt charges allocation, the interest on the capital debt allocation and the pupil accommodation allocation.

2.  Add the amount of the board’s adjustment for declining enrolment for the current fiscal year to the amount determined under paragraph 1.

3.  Determine the total of the following amounts for the board:

i.  The amount determined under paragraph 3 of subsection 20 (1).

ii.  The amount specified under subsection 22 (1).

iii.  The amount determined under subsection 23 (1).

iv.  The amount specified for the board in Column 3 of the Table to this section.

4.  Subtract the amount determined under paragraph 3 from the amount determined under paragraph 2.

5.  Subtract the amount determined under paragraph 4 from the amount specified for the board in Column 2 of the Table to this section.

6.  Take the greater of 0 and the amount determined under paragraph 5.

Commencement

10. This Regulation comes into force on the day it is filed.
