Amending O. Reg. 359/09

(RENEWABLE ENERGY APPROVALS UNDER PART V.0.1 OF THE ACT)

1. Subsection 9 (1) of Ontario Regulation 359/09 is amended by adding the following paragraph:

12. The project is in respect of a thermal treatment facility where any of the following are wholly utilized as a fuel or fuel supplement in a combustion unit or are subject to incineration or gasification, without being combined with any other solid or liquid fuel that is, or that is derived from, biomass or waste biomass:

i. Firewood.

ii. Manufactured fire logs.

iii. Hogged wood fuel.

iv. Wood chips.

v. Wood pellets.

vi. Wood briquettes.

vii. Bark.

viii. Sawdust.

ix. Woodwaste.

x. Pulp and paper biosolids within the meaning of Ontario Regulation 267/03 (General) made under the Nutrient Management Act, 2002.

xi. Pyrolysis fuel oil derived from wood biomass.

Commencement

2. This Regulation comes into force on the later of July 1, 2021 and the day it is filed.
