Amending O. Reg. 364/20

(RULES FOR AREAS AT STEP 3 AND AT THE ROADMAP EXIT STEP)

1. (1) Subsection 2.1 (2) of Schedule 1 to Ontario Regulation 364/20 is amended by adding the following paragraph:

10.  Any of the following outdoor areas that have a usual capacity of 20,000 or more persons:

i.  Outdoor meeting and event spaces, including conference centres or convention centres, but not including places described in subsection 4 (2) of this Schedule.

ii.  Outdoor facilities used for sports and recreational fitness activities, including waterparks and personal physical fitness trainers, including, for greater certainty, the outdoor areas of facilities where spectators watch events, but not including places described in subsection 16 (4) of Schedule 2.

iii.  Outdoor concert venues, theatres and cinemas.

iv.  Outdoor horse racing tracks, car racing tracks and other similar venues.

(2) Clauses 2.1 (6) (b), (d), (e) and (f) of Schedule 1 to the Regulation are amended by striking out “indoor” wherever it appears.

(3) Paragraph 1 of subsection 4 (1) of Schedule 1 to the Regulation is amended by striking out “1,000 persons” and substituting “10,000 persons”.

(4) Paragraph 3 of subsection 4 (1) of Schedule 1 to the Regulation is revoked and the following substituted:

3.  The total number of members of the public permitted to be in an outdoor portion of the rentable meeting or event space at any one time may not exceed the least of the following:

i.  75 per cent capacity, as determined in accordance with subsection 3 (2) of this Schedule.

ii.  30,000 persons, in the case of a seated meeting or event.

iii.  15,000 persons, in the case of an unseated meeting or event.

2. (1) Subparagraph 2 i of subsection 16 (1) of Schedule 2 to the Regulation is amended by striking out “1,000” and substituting “10,000”.

(2) Subparagraph 2 ii of subsection 16 (1) of Schedule 2 to the Regulation is amended by striking out “15,000” and substituting “30,000”.

(3) Subparagraph 2 iii of subsection 16 (1) of Schedule 2 to the Regulation is amended by striking out “1,000” and substituting “10,000”.

(4) Subparagraph 2 iv of subsection 16 (1) of Schedule 2 to the Regulation is amended by striking out “5,000” and substituting “15,000”.

(5) Paragraph 2 of subsection 20 (1) of Schedule 2 to the Regulation is amended by striking out “1,000” and substituting “10,000”.

(6) Paragraph 1 of subsection 22 (1) of Schedule 2 to the Regulation is amended by striking out “15,000” and substituting “30,000”.

(7) Paragraph 2 of subsection 22 (1) of Schedule 2 to the Regulation is amended by striking out “5,000” and substituting “15,000”.

(8) Paragraph 3 of subsection 22 (1) of Schedule 2 to the Regulation is amended by striking out “1,000” and substituting “10,000”.

(9) Paragraph 1 of subsection 26 (1) of Schedule 2 to the Regulation is amended by striking out “1,000” and substituting “10,000”.

(10) Paragraph 2 of subsection 26 (1) of Schedule 2 to the Regulation is amended by striking out “15,000” and substituting “30,000”.

(11) Paragraph 3 of subsection 26 (1) of Schedule 2 to the Regulation is amended by striking out “5,000” and substituting “15,000”.

Commencement

3. This Regulation comes into force on the later of September 25, 2021 and the day it is filed.
