Amending Reg. 296 of R.R.O. 1990
(ONTARIO SCHOOLS FOR THE BLIND AND THE DEAF)
1. (1) The definition of “residence counsellor” in section 1 of Regulation 296 of the Revised Regulations of Ontario, 1990 is revoked.
(2) Section 1 of the Regulation is amended by adding the following definition:
“student support counsellor” means a person employed as a student support counsellor in a School; (“conseiller en soutien aux élèves”)
2. Section 5 of the Regulation is revoked and the following substituted:
5. (1) The Superintendent shall admit an applicant if,
(a) an entity referred to in subsection (2) requests admission for the applicant;
(b) the applicant,
(i) is an Indian to whom clause 3 (1) (b) applies, and
(ii) is not inadmissible under subsection 8 (1);
(c) one of the entities referred to in subsection (2) agrees to pay such fees as are payable for the instruction and maintenance of the applicant; and
(d) the Minister approves the admission of the applicant.
(2) The entities referred to in subsection (1) are,
(a) the Crown in right of Canada;
(b) a band;
(c) a council of a band; and
(d) an education authority that is authorized by a band, a council of a band or by the Crown in right of Canada.
3. Section 7 of the Regulation is amended by striking out “accommodation” and substituting “lodging”.
4. (1) Paragraph 1 of subsection 10 (4) of the Regulation is revoked and the following substituted:
1. For the schools designated in section 2, determine the total of their estimated operating costs for the fiscal year, excluding, where applicable, the estimated costs of external resource services, teacher education, lodging operating expenses and student support counsellors, food services, the laundry, the summer course for parents, the media centre and any special projects.
(2) Subparagraph 1 ii of subsection 10 (5) of the Regulation is amended by striking out “residence counsellor” at the beginning and substituting “student support counsellor”.
5. Section 14 of the Regulation is amended by adding “and” at the end of clause (e), by striking out “and” at the end of clause (f) and by revoking clause (g).
6. The heading before section 16 and section 16 of the Regulation are revoked.
7. (1) Clause 18 (b) of the Regulation is revoked.
(2) Clause 18 (o) of the Regulation is amended by striking out “and the residences”.
8. (1) Subparagraph 1 ii of section 24 of the Regulation is revoked.
(2) Paragraph 2 of section 24 of the Regulation is revoked and the following substituted:
2. Substitute “director of education of the Centre Jules-Léger Consortium” for “Director” and for “Superintendent” wherever they appear, except in section 1 and as provided in paragraph 3.
9. (1) The following provisions of the Regulation are amended by striking out “residence” wherever it appears and substituting in each case “lodging”:
1. The heading before section 8.1.
2. Subsection 8.1 (2).
3. Subparagraph 1 i of subsection 10 (5).
(2) The following provisions of the Regulation are amended by striking out “in residence” wherever it appears and substituting in each case “in a lodging”:
1. Subsection 10 (2).
2. Subsection 10 (3).
3. Subparagraph 1 iv of subsection 10 (5).
4. Paragraph 2 of subsection 10 (5).
Commencement
10. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.
(2) Sections 1 and 3 to 7, subsection 8 (2) and section 9 come into force on the later of January 1, 2023 and the day this Regulation is filed.
