Amending Reg. 552 of R.R.O. 1990

(GENERAL)

1. The definition of “schedule of benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 is amended by adding the following paragraph:

40.  Amendments dated October 5, 2022 (effective as of December 1, 2022);

2. Subsection 29 (1) of the Regulation is revoked and the following substituted:

(1) A service rendered by a physician outside Ontario is an insured service if, at the time the service is rendered,

(a)  the physician is authorized to practice in the jurisdiction outside Ontario where the physician and insured person are both physically located at the time of the service;

(b)  both the physician and the insured person are physically located in the jurisdiction referred to in clause (a); and

(c)  the service is referred to in the schedule of benefits and rendered in such circumstances or under such conditions as may be specified in the schedule of benefits.

3. Subsections 37.1 (1) and (2) of the Regulation are revoked and the following substituted:

(1) A service rendered by a physician in Ontario is an insured service if, at the time the service is rendered,

(a)  the physician is a member of the College of Physicians and Surgeons of Ontario;

(b)  both the physician and the insured person are physically located in Ontario; and

(c)  the service is referred to in the schedule of benefits and rendered in such circumstances or under such conditions as may be specified in the schedule of benefits.

(2) The basic fee payable by the Plan for an insured service described in subsection (1) is the fee payable under the schedule of benefits.

4. This Regulation comes into force on December 1, 2022.
