Amending Reg. 628 of R.R.O. 1990

(VEHICLE PERMITS)

1. Subsection 5.1 (3) of Regulation 628 of the Revised Regulations of Ontario, 1990 is revoked and the following substituted:

(3) A permit is validated until the expiry date set out in the records of the Ministry.

2. The Regulation is amended by adding the following sections:

Validation Under Section 7.0.1 of the Act

8.5 (1) Subject to subsections (2) and (3), a permit for the following classes of motor vehicle may be validated under section 7.0.1 of the Act:

1. Passenger cars.

2. Motorcycles.

3. Motor assisted bicycles.

4. Commercial motor vehicles with a gross weight of not more than 3,000 kilograms and which are used primarily for personal transportation, but not including buses.

(2) A motor vehicle shall not be validated under section 7.0.1 of the Act if,

(a) in the records of the Ministry, a number plate has not been approved for use on the vehicle;

(b) it is branded salvage or irreparable;

(c) the model year of the vehicle is before 1983;

(d) the vehicle was manufactured prior to 1983;

(e) the permit for the vehicle refers to a dealer number plate, a service number plate, a dealer and service number plate or a manufacturer number plate; or

(f) the permit holder is described in section 20.

(3) A permit for a motor vehicle described in subsection (1) may be validated only if the Ministry is satisfied that the following requirements are met:

1. The holder of the permit is an individual.

2. Neither the permit nor the holder of the permit is subject to subsections 7 (9), (10) and (12.0.1) of the Act.

3. Neither the permit nor the holder of the permit is subject to a refusal to issue or validate a permit under section 22 of the Highway 407 Act,1998 or section 11 of the Highway 407 East Act, 2012.

4. There is a valid contract of automobile insurance for the motor vehicle, as required by section 2 of the Compulsory Automobile Insurance Act.

(4) If the Ministry is not satisfied that the requirements set out in subsection (3) are met, the Ministry shall, on or after the expiry date of the permit, change the status of the permit to expired.

8.6 For the purposes of clause 7.0.1 (2) (b) of the Act, the Ministry may change the period of validation or date of expiry of any permit.

Commencement

3. This Regulation comes into force on the later of the day section 6 of Schedule 2 to the Get It Done Act, 2024 comes into force and the day this Regulation is filed.
