Amending O. Reg. 136/98
(DESIGNATION OF GEOGRAPHIC AREAS AND DELIVERY AGENTS)
1. The title of Ontario Regulation 136/98 is revoked and the following substituted:
DESIGNATION OF GEOGRAPHIC AREAS, DELIVERY AGENTS AND DELIVERY PARTNERS
2. Section 1 of the Regulation is revoked and the following substituted:
1. (1) The territories, as constituted from time to time, of the municipalities and district social services administration boards set out in Column 1 of Schedule 1, are designated as geographic areas.
(2) The entity set out opposite to each geographic area in Column 2 of Schedule 1 is designated as the delivery agent for that geographic area, and the entity, if any, set out opposite to each geographic area in Column 3 of Schedule 1 is designated as the delivery partner for that geographic area.
3. Section 2.3 of the Regulation is amended by striking out “in the Ministry at the Ontario Works Branch, 5th Floor, 375 University Avenue, Toronto, Ontario M5G 2J5” and substituting “from the Ministry”.
4. (1) Clause 4 (a) of the Regulation is revoked and the following substituted:
(a) the other entity is another delivery agent, a delivery partner, a municipality, a band, a district social services administration board or the aboriginal tribal council known as the “Kenora Chiefs Advisory Inc.”;
(2) Section 4 of the Regulation is amended by adding the following subsection:
(2) If the Ministry is the delivery agent in a geographic area, the limitation set out in subsection (1) does not apply.
5. The Regulation is amended by adding the following sections:
5. Each delivery partner is authorized to perform the powers and duties of an administrator that relate to the administration of the Act and the provision of assistance in the delivery partner’s geographic area, except for,
(a) powers and duties relating to appeals to Divisional Court; and
(b) the power under section 46 of the Act to delegate the administrator’s powers and duties to employees of a delivery agent.
6. (1) Subject to subsection (2), a delivery partner may enter into an agreement with regard to any matter relating to the performance of the delivery partner’s powers and duties in the delivery partner’s geographic area.
(2) A delivery partner may enter into an agreement giving another entity authority to determine eligibility for assistance only if,
(a) the other entity is another delivery agent, a delivery partner, a municipality, a band, a district social services administration board or the aboriginal tribal council known as the “Kenora Chiefs Advisory Inc.”;
(b) the agreement requires the entity to comply with any duties of the delivery partner under the Act with respect to that authority; and
(c) the agreement authorizes the delivery partner to cancel the agreement if the entity does not comply with those duties.
7. (1) Each delivery partner shall provide to the Director information relevant to the performance of its powers and duties under the Act that is requested by the Director, including information about present and former applicants and recipients under the Act, the Ontario Disability Support Program Act, 1997, the Family Benefits Act or the General Welfare Assistance Act.
(2) The information shall be provided in the form and manner requested by the Director.
8. (1) Information collected by a delivery partner for the purposes of the Act may be used by the delivery partner and the delivery agent for the purposes of and in accordance with the Act.
(2) Personal information collected by a delivery partner for the purposes of this Act may be used by the delivery partner and the delivery agent only for the purpose for which it was collected or for a consistent purpose or as authorized under the Act.
(3) Each delivery partner shall keep information collected under the Act in the form and electronic system required by the Director.
9. Each delivery partner shall be subject to the powers of the Director set out in section 48 of the Act.
10. (1) Each delivery partner may establish a local fraud control unit.
(2) Subsections 57 (3) and (4) of the Act apply to a local fraud control unit established under subsection (1).
11. (1) Each delivery partner is,
(a) responsible for the payment or provision of discretionary benefits in the delivery partner’s geographic area in accordance with subsection 57.2 (3) and section 59 of Ontario Regulation 134/98 (General) made under the Act; and
(b) entitled to recover amounts in accordance with subsection 59 (5) of Ontario Regulation 134/98.
6. Schedule 1 to the Regulation is revoked and the following substituted:

Commencement
7. This Regulation comes into force on the later of October 1, 2024 and the day this Regulation is filed.
