Amending O. Reg. 176/10

(TEACHERS’ QUALIFICATIONS)

1. (1) Clause (b) of the definition of “acceptable certificate, diploma or advanced diploma” in subsection 1 (1) of Ontario Regulation 176/10 is revoked and the following substituted:

(b) by a career college approved to grant the certificate, diploma or advanced diploma under the Ontario Career Colleges Act, 2005 or a predecessor Act, or

(2) The definition of “general education” in subsection 1 (1) of the Regulation is revoked and the following substituted:

“general education” means the curriculum, including curriculum guidelines and courses of study for the intermediate and senior divisions issued or prescribed under subsection 8 (1) of the Education Act, as set out in the secondary curriculum documents available on a website of the government of Ontario, as amended from time to time, but does not include technological education; (“éducation générale”)

(3) The definition of “technological education” in subsection 1 (1) of the Regulation is revoked and the following substituted:

“technological education” means the curriculum, including curriculum guidelines and courses of study for grades 9 and 10 and for grades 11 and 12 issued or prescribed under subsection 8 (1) of the Education Act, as set out in the secondary curriculum document entitled “Technological Education” available on a website of the government of Ontario, as amended from time to time; (“éducation technologique”)

(4) The definition of “temporary certificate of qualification and registration” in subsection 1 (1) of the Regulation is revoked.

2. Paragraph 3 of section 2 of the Regulation is revoked.

3. Section 2.1 of the Regulation is revoked.

4. Clause 4 (3) (f.1) of the Regulation is revoked.

5. Clause 5 (1) (g.1) of the Regulation is revoked.

6. Clause 6.1 (3) (g.1) of the Regulation is revoked and the following substituted:

(g.1) despite clause (g), if the previous certificate was a transitional or multi-session transitional certificate of qualification and registration and was issued before February 1, 2025, evidence satisfactory to the Registrar that the requirements of section 16, as they read on the day the certificate was granted, have been satisfied, and that the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

(h) if the previous certificate was a temporary certificate of qualification and registration, evidence satisfactory to the Registrar that the requirements of section 17.3, as they read on the day the certificate was granted or the day the certificate was extended under subsection 17.1 (7) or 17.2 (2), have been satisfied, and that the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

7. Clause 6.2 (3) (g.1) of the Regulation is revoked and the following substituted:

(g.1) despite clause (g), if the previous certificate was a transitional or multi-session transitional certificate of qualification and registration and was issued before February 1, 2025, evidence satisfactory to the Registrar that the requirements of section 16, as they read on the day the certificate was granted, have been satisfied, and that the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

(h) if the previous certificate was a temporary certificate of qualification and registration, evidence satisfactory to the Registrar that the requirements of section 17.3, as they read on the day the certificate was granted or the day the certificate was extended under subsection 17.1 (7) or 17.2 (2), have been satisfied, and that the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

8. Clause 13.1 (2) (a.1) of the Regulation is revoked and the following substituted:

(a.1) despite clause (a), if the applicant previously held a transitional or multi-session transitional certificate that was issued prior to February 1, 2025, the requirements of section 16, as they read on the day the certificate was granted, have been satisfied and the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

(a.2) if the applicant previously held a temporary certificate, the requirements of section 17.3, as they read on the day the certificate was granted or the day the certificate was extended under subsection 17.1 (7) or 17.2 (2), have been satisfied, and the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act; and

9. Clause 13.2 (2) (a.1) of the Regulation is revoked and the following substituted:

(a.1) despite clause (a), if the applicant previously held a transitional or multi-session transitional certificate that was issued prior to February 1, 2025, the requirements of section 16, as they read on the day the certificate was granted, have been satisfied and the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act;

(a.2) if the applicant previously held a temporary certificate, the requirements of section 17.3, as they read on the day the certificate was granted or the day the certificate was extended under subsection 17.1 (7) or 17.2 (2), have been satisfied, and the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act; and

10. Subsection 16 (1) of the Regulation is amended by striking out “and” after clause (a), adding “and” after clause (b) and by adding the following clause:

(c) the applicant has successfully completed the mathematics test referred to in Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act.

11. The heading immediately before section 17. 1 and sections 17.1 to 17.4 of the Regulation are revoked.

12. (1) Subsection 18 (1) of the Regulation is amended by striking out “14.1, 16, 17.1 or 17.3” and substituting “14.1 or 16”.

(2) Subsection 18 (2) of the Regulation is amended by striking out “13, 15, or 17.2” and substituting “13 or 15”.

(3) Subsection 18 (3) of the Regulation is amended by adding “of Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act” after “subsection 2 (3)”.

13. Subclause 19 (1) (b) (iii) of the Regulation is revoked.

14. Section 51 of the Regulation is revoked and the following substituted:

Suspension

51. (1) The Registrar may suspend a member’s certificate of qualification and registration for failure to provide evidence satisfactory to the Registrar that they have successfully completed the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act.

(2) The Registrar shall not suspend a member’s certificate of qualification and registration without first giving the member two-months notice of the default and intention to suspend.

(3) A person whose certificate of qualification and registration was suspended by the Registrar under subsection (1) is entitled to have the suspension removed upon providing evidence satisfactory to the Registrar that they have successfully completed the program and paying the reinstatement fee required by the by-laws.

15. The Regulation is amended by striking out “multi-session transitional or temporary” wherever it appears and substituting in each case “or multi-session transitional”.

Commencement

16. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Sections 6 to 10 come into force on the later of February 1, 2025 and the day this Regulation is filed.
