Amending O. Reg. 275/94

(GENERAL)

1. Subsection 1.2 (3) of Ontario Regulation 275/94 is amended by striking out “he or she meets” and substituting “they meet”.

2. Subsection 1.3 (2) of the Regulation is amended by striking out “he or she” and substituting “they”.

3. (1) Subparagraph 2 i of subsection 1.4 (1) of the Regulation is amended by striking out “his or her” and substituting “the applicant’s”.

(2) Subsection 1.4 (4) of the Regulation is amended by striking out “he or she filed his or her” and substituting “the applicant filed their”.

(3) Subsection 1.4 (5) of the Regulation is amended by striking out “his or her” and substituting “their”.

4. Paragraph 3 of subsection 1.5 (2) of the Regulation is amended by striking out “he or she” and substituting “the member”.

5. (1) Subparagraphs 1 ii and iii of subsection 2 (1) of the Regulation are revoked and the following substituted:

ii.  must have a minimum of a baccalaureate degree in nursing evidencing the successful completion of a program specifically designed to educate and train persons to be practising registered nurses, other than a program mentioned in subparagraph i, that was, at the time the applicant completed the program, recognized or approved in the jurisdiction in which the program was taken as qualifying the applicant to practise as a registered nurse in that jurisdiction, or

iii.  must have successfully completed a program in nursing specifically designed to educate and train persons to be practising registered nurses, other than a program mentioned in subparagraph i or ii, that was, at the time the applicant completed the program, recognized or approved, in the jurisdiction in which the program was taken as qualifying the applicant to practise as a registered nurse in that jurisdiction, and,

A.  the program is one that the Registration Committee determines has provided the applicant with knowledge, skill and judgment that is substantially equivalent to those of current graduates of a program mentioned in subparagraph i, or

B.  must have paid any fees required under the by-laws, undergone an evaluation approved by the Registration Committee and satisfied the Executive Director or a panel of the Registration Committee that the applicant has successfully completed further education or training or a combination of education and training approved by t he Registration Committee that was identified in the evaluation as necessary to evidence that the applicant possesses knowledge, skill and judgment that is substantially equivalent to those of current graduates of a program mentioned in subparagraph i.

(2) Paragraph 2 of subsection 2 (1) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(3) Subparagraphs 3 i and ii of subsection 2 (1) of the Regulation are revoked and the following substituted:

i.  must have completed the applicable requirements in paragraph 1 no more than three years before the day that the applicant met all other requirements for the issuance of the certificate of registration,

(4) Paragraph 5 of subsection 2 (1) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the applicant”.

(5) Subsection 2 (1) of the Regulation is amended by adding the following paragraph:

6.  The applicant must, within five years before the day that the applicant is issued the certificate of registration, have successfully completed a program or course regarding successful integration to the health care system in Canada that is approved by the Council for applicants for the issuance of a certificate of registration as a registered nurse.

(6) Subsection 2 (2) of the Regulation is revoked.

(7) Subsections 2 (4) and (5) of the Regulation are revoked and the following substituted:

(4) An applicant is exempt from the requirements in paragraphs 1, 2, 5 and 6 of subsection (1) if the applicant holds a certificate of registration in the extended class at the time that the applicant applies for the issuance of a certificate of registration as a registered nurse in the General class.

(5) An applicant is deemed to have satisfied the requirement in paragraph 6 of subsection (1) if the applicant completed a recognized or approved registered nurse program in Canada within the last three years, practised nursing in Canada within the last three years or satisfies a panel of the Registration Committee that the applicant has successfully completed education or training or a combination of education and training that is substantially equivalent to the requirement in paragraph 6 of subsection (1).

(6) Subject to subsections (3), (4) and (5) and section 2.1, the requirements in subsection (1) of this section are non-exemptible.

6. (1) Subsection 2.1 (1) of the Regulation is amended by striking out “paragraphs 1, 2 and 3” and substituting “paragraphs 1, 2, 3 and 6”.

(2) Subsection 2.1 (5) of the Regulation is amended by striking out “paragraph 1, 2 or 3” and substituting “paragraph 1, 2, 3 or 6”.

7. Subsection 2.2 (2) of the Regulation is amended by striking out “he or she” and substituting “the member”.

8. (1) Subparagraphs 1 ii and iii of subsection 3 (1) of the Regulation are revoked and the following substituted:

ii.  must have a minimum of a diploma in practical nursing evidencing the successful completion of a program specifically designed to educate and train persons to be practising registered practical nurses, other than a program mentioned in subparagraph i, that was, at the time the applicant completed the program, recognized or approved in the jurisdiction in which the program was taken as qualifying the applicant to practise as a registered practical nurse in that jurisdiction,

iii.  must have successfully completed a program in practical nursing specifically designed to educate and train persons to be practising registered practical nurses, other than a program mentioned in subparagraph i or ii, that was, at the time the applicant completed the program, recognized or approved in the jurisdiction in which the program was taken as qualifying the applicant to practise as a registered practical nurse in that jurisdiction, and,

A.  the program is one that the Registration Committee determines has provided the applicant with knowledge, skill and judgment that is substantially equivalent to those of current graduates of a program mentioned in subparagraph i, or

B.  must have paid any fees required under the by-laws, undergone an evaluation approved by the Registration Committee and satisfied the Executive Director or a panel of the Registration Committee that the applicant has successfully completed further education or training or a combination of education and training approved by the Registration Committee that was identified in the evaluation as necessary to evidence that the applicant possesses knowledge, skill and judgment that is substantially equivalent to those of current graduates of a program mentioned in subparagraph i.

(2) Subparagraph 1 v of subsection 3 (1) of the Regulation is revoked and the following substituted:

v.  must, if the applicant has not satisfied the requirements of paragraph 1 of subsection 2 (1), have successfully completed a program in nursing specifically designed to educate and train persons to be practising registered nurses, that was recognized or approved in the jurisdiction in which the program was taken as qualifying the applicant to practise as a registered nurse, must have paid any fees required under the by-laws, undergone an evaluation approved by the Registration Committee and satisfied the Executive Director or a panel of the Registration Committee that the applicant has successfully completed further education or training or a combination of education and training approved by the Registration Committee that was identified in the evaluation as necessary to evidence that the applicant possesses knowledge, skill and judgment that is substantially equivalent to those of current graduates of a program mentioned in subparagraph i.

(3) Paragraph 2 of subsection 3 (1) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(4) Subparagraphs 3 i and ii of subsection 3 (1) of the Regulation are revoked and the following substituted:

i.  must have completed the applicable requirements in paragraph 1 no more than three years before the day that the applicant met all other requirements for the issuance of the certificate of registration,

(5) Paragraph 4 of subsection 3 (1) of the Regulation is amended by striking out “within five years before the day that the applicant is issued a certificate as a registered practical nurse” and substituting “within five years before the day that the applicant is issued the certificate of registration”.

(6) Paragraph 5 of subsection 3 (1) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the applicant”.

(7) Subsection 3 (1) of the Regulation is amended by adding the following paragraph:

6.  The applicant must, within five years before the day that the applicant is issued the certificate of registration, have successfully completed a program or course regarding successful integration to the health care system in Canada that is approved by the Council for applicants for the issuance of a certificate of registration as a registered practical nurse.

(8) Subsection 3 (2) of the Regulation is revoked.

(9) Subsection 3 (4) of the Regulation is revoked and the following substituted:

(4) An applicant is deemed to have satisfied the requirement in paragraph 6 of subsection (1) if the applicant completed a recognized or approved registered practical nurse program or registered nurse program in Canada within the last three years, practised nursing in Canada within the last three years or satisfies a panel of the Registration Committee that the applicant has successfully completed education or training or a combination of education and training that is substantially equivalent to the requirement in paragraph 6 of subsection (1).

(5) Subject to subsections (3) and (4) and section 3.1, the requirements in subsection (1) of this section are non-exemptible.

9. (1) Subsection 3.1 (1) of the Regulation is amended by striking out “paragraphs 1, 2 and 3” and substituting “paragraphs 1, 2, 3 and 6”.

(2) Subsection 3.1 (5) of the Regulation is amended by striking out “paragraph 1, 2 or 3” and substituting “paragraph 1, 2, 3 or 6”.

10. Section 3.2 of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the member”.

11. (1) Paragraph 2 of subsection 4 (1) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the applicant”.

(2) Sub-subparagraph 2 iv B of subsection 4 (1) of the Regulation is amended by striking out “being”.

(3) Paragraph 3 of subsection 4 (1) of the Regulation is revoked and the following substituted:

3.  The applicant must have successfully completed an examination in that specialty in the extended class for which the applicant applied at a time when that examination was approved by Council and at a time when they were eligible under section 9.1 to take that examination, or must have successfully completed an examination approved by Council for that purpose.

(4) Paragraph 4 of subsection 4 (1) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the applicant”.

(5) Sub-subparagraph 4 iii B of subsection 4 (1) of the Regulation is amended by striking out “him or her” and substituting “the applicant”.

(6) Paragraph 6 of subsection 4 (1) of the Regulation is amended by striking out “he or she” in the portion before subparagraph i and substituting “the applicant”.

(7) Subparagraph 6 i of subsection 4 (1) of the Regulation is amended by striking out “he or she submits” and substituting “they submit”.

(8) Subsection 4 (3) of the Regulation is amended by striking out “he or she” in the portion before clause (a) and substituting “the applicant”.

12. Subsection 4.2 (8) of the Regulation is amended by striking out “himself or herself” and substituting “themselves”.

13. Paragraph 5 of subsection 5 (1) of the Regulation is amended by striking out “he or she is” in the portion before subparagraph i and substituting “they are”.

14. (1) Paragraph 1 of subsection 5.1 (1) of the Regulation is amended by striking out “his or her” and substituting “the member’s”.

(2) Paragraph 7 of subsection 5.1 (1) of the Regulation is amended by striking out “himself or herself” and substituting “themselves”.

15. (1) Subsection 5.2 (1) of the Regulation is amended by striking out “paragraphs 2 and 7” and substituting “paragraph 7”.

(2) Subsection 5.2 (5) of the Regulation is amended by striking out “paragraph 2 or 7” and substituting “paragraph 7”.

16. (1) Paragraph 1 of subsection 6 (1) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(2) Paragraph 1 of subsection 6 (3) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(3) Subsection 19.1 (2) of the Regulation is amended by,

30. (1) Clause 24 (1) (a) of the Regulation is amended by striking out “his or her” and substituting “the member’s”.

(2) Subsection 24 (4) of the Regulation is amended by striking out “his or her” in the portion before clause (a) and substituting “the member’s”.

31. Subsection 25 (3) of the Regulation is amended by,

(a)  striking out “his or her” and substituting “their”; and

32. Subsection 26 (2) of the Regulation is amended by striking out “he or she” and substituting “the member”.

33. Subsection 30 (3) of the Regulation is amended by,

39. (1) Schedule 1 to the Regulation is amended by striking out “Independent Health Facilities under the Independent Health Facilities Act” and substituting “Integrated Community Health Services Centres under the Integrated Community Health Services Centres Act, 2023”.

(2) Schedule 1 to the Regulation is amended by striking out “and Long-Term Care” wherever it appears.

Commencement

40. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Sections 1 to 14 and 16 to 39 come into force on the later of April 1, 2025 and the day this Regulation is filed.
