Amending O. Reg. 665/98

(HUNTING)

1. (1) Subsections 62 (2) to (3.1) of Ontario Regulation 665/98 are revoked and the following substituted:

(2) For any subsequent and successive failure to submit a hunter report for the same species within the time specified for that species under section 58, 59 or 60, subsection (1) does not apply and instead, the person shall pay a penalty of $50 the next time the person applies for a licence to hunt that species.

(2.1) For greater certainty, if no penalty is payable as a result of subsection (4) for a failure to submit a hunter report, the next time a hunter fails to submit a report for the same species, the person shall pay the penalty under subsection (1), even if subsection (2) would otherwise apply.

(2.2) Subsection (2) applies if the subsequent and successive failure to submit a hunter report within the time specified was in respect of a report that was required to be submitted any time after July 1, 2026.

(3) The Minister shall not issue a licence to hunt a species to a person who is required to pay a penalty under subsection (1) or (2) for having previously failed to submit a hunter report with respect to the species, until the person pays the penalty.

(3.1) Despite subsection (3) of this Regulation as it read the day before Ontario Regulation 472/24 made under the Act came into force, if a person’s failure to submit a subsequent and successive hunter report within the time specified for a species occurs between June 14, 2024 and the day Ontario Regulation 472/24 made under the Act comes into force, the Minister may issue a licence to the person if they pay the penalty required under subsection (1).

(2) Subsection 62 (6) of the Regulation is amended by striking out “subsections (2) and (3)” and substituting “subsection (3)”.

Commencement

2. This Regulation comes into force on the later of January 1, 2025 and the day this Regulation is filed.
