Amending O. Reg. 246/22
(GENERAL)
1. Ontario Regulation 246/22 is amended by adding the following section:
Modified Waiting List
Modified waiting list designation
239.1 (1) The Director may designate a long-term care home, or a unit or area within the home, as being subject to the modified waiting list rules described in subsection (5), subject to any terms and conditions as the Director may specify in the designation.
(2) A licensee shall comply with the terms and conditions of a designation.
(3) The Director may, at any time, amend the terms and conditions of a designation or revoke the designation.
(4) The Director shall advise the licensee for the long-term care home designated under subsection (1) and advise the appropriate placement co-ordinator in writing of,
(a) the designation and any terms and conditions to which it is subject;
(b) if the Director amends the terms and conditions, the amended terms and conditions; and
(c) if the Director revokes the designation, the revocation of the designation.
(5) Section 200 applies, with the following modifications, to the ranking of applicants on a waiting list for beds in a long-term care home, or unit or area within the home, that is designated under subsection (1):
1. Item 10 to the Table to section 200 shall be read as follows:
10. | 1 (Crisis) | Applicants shall be ranked according to the urgency of their need for admission. | If there are two or more applicants who are ranked in the same position within category 1 (crisis) according to the urgency of their need for admission, as between themselves, any applicant who is, or whose spouse or partner is, of the religion, ethnic origin or linguistic origin primarily served by the designated long-term care home or unit or area within the home shall rank ahead of the other applicants. |
(6) If a long-term care home, or unit or area within a home, is designated under subsection (1), the appropriate placement co-ordinator shall reorganize the waiting list for the long-term care home, unit or area to reflect the modifications set out in subsection (5).
(7) If a designation under subsection (1) is revoked, the appropriate placement co-ordinator shall reorganize the waiting list for the long-term care home, unit or area to reflect the revocation of the designation.
Commencement
2. This Regulation comes into force on the later of January 1, 2025 and the day this Regulation is filed.
