ZONING ORDER - TOWN OF BRADFORD WEST GWILLIMBURY
Definition
1. In this Order,
“zoning by-law” means Zoning By-law 2010-050 in the Town of Bradford West Gwillimbury.
Application
2. This Order applies to lands in the Town of Bradford West Gwillimbury, in the County of Simcoe, in the Province of Ontario, being the lands outlined in red on a map numbered 370 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.
Non-application of s. 41 of the Act, site plan control area
3. Section 41 of the Act does not apply to the lands described in section 2 of this Order.
Matters that may be dealt with in agreement
4. (1) Each person who owns all or any part of the lands described in section 2 shall enter into one or more agreements with the Town of Bradford West Gwillimbury dealing with the matters listed in subsection 47 (4.4) of the Act.
(2) Subsection (1) does not apply to the lands in the area shown as “Portable Concrete Batching Facility Lands” on the map referred to in section 2.
Permitted uses
5. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for the following uses:
1. The agricultural uses permitted by Part 9 of the zoning by-law.
2. Subject to subsection (2), a facility designed to mix cementing materials, aggregate, water and admixtures to produce concrete or concrete products used in building or construction and to manufacture finished concrete products, including retaining wall products.
3. Administration or management facilities used in connection with a facility described in paragraph 2.
4. Maintenance and fuelling of equipment and vehicles used in the production process referred to in paragraph 2.
5. Retail sale of finished concrete products, including retaining wall products.
6. Storage not required to be inside of a building or structure, including,
i. the stockpiling and storage of finished products manufactured at a facility referred to in paragraph 2, and
ii. bulk materials, vehicles and equipment for the production process referred to in paragraph 2.
7. Charging of vehicles that use one or more electric motors for propulsion.
8. A facility used for the sale, bulk storage and distribution of hydrogen, propane or similar substances but not gasoline or diesel.
9. Accessory uses, buildings or structures to any permitted uses.
(2) For the period ending December 20, 2026, with respect to lands in the area shown as “Portable Concrete Batching Facility Lands” on the map referred to in section 2, a facility referred to in paragraph 2 of subsection (1) must,
(a) be portable, and may be trailer-mounted making it mobile; and
(b) not be of permanent construction, but is to be dismantled at the completion of the construction of a permanent facility described in paragraph 2 of subsection (1).
Zoning requirements
6. The zoning requirements for the lands described in section 2 are as follows:
1. The minimum required front yard is 6.0 metres.
2. The minimum required interior side yard or exterior side yard is 6.0 metres.
3. The minimum required rear yard is 7.5 metres.
4. The maximum height of any building or structure is 11.0 metres. However, with respect to a silo, mixing unit or conveyor associated with a permitted use, the maximum height is 19.5 metres.
5. There is no maximum lot coverage requirement.
6. Parking shall be provided in accordance with the Town of Bradford West Gwillimbury Parking Standards in Part 5 of the zoning by-law, with the following exceptions:
i. The parking of any motor vehicles, including outdoor storage of unlicensed or inoperative vehicles, shall be permitted as an accessory use to any permitted use on the lands described in section 2.
ii. One space shall be provided per 30 metres of gross floor area.
iii. No bicycle parking spaces are required
Terms of use
7. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.
(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.
(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use is not altered.
(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.
Deemed by-law
8. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the Town of Bradford West Gwillimbury.
Revocation
9. Subsection 4 (2) of this Regulation is revoked.
Commencement
10. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.
(2) Section 9 comes into force on December 20, 2026.
