Amending O. Reg. 422/17
(GENERAL)
1. Subparagraph 9 i of subsection 4 (1) of Ontario Regulation 422/17 is amended by striking out “with a job offer”.
2. (1) Section 5 of the Regulation is amended by striking out the portion before paragraph 0.1 and substituting the following:
Foreign worker
5. For the purposes of subsection 16 (2) of the Act, the following criteria are prescribed for an applicant for a certificate of nomination in the foreign worker category, if the applicant is or will be an employee:

(2) For the purposes of subsection 16 (2) of the Act, the following criteria are prescribed for an applicant for a certificate of nomination in the foreign worker category, if the applicant is or will be self-employed:
1. The applicant must be registered and in good standing with the College of Physicians and Surgeons of Ontario in one of the following certificate categories that permits patient care:
i. Independent practice.
ii. Academic practice.
iii. Postgraduate education.
2. The applicant must be eligible to receive payment for publicly funded health services in accordance with the Health Insurance Act.
3. Section 10 of the Regulation is amended by adding the following paragraph:
5.0.1 If the applicant is a member of the Canadian experience class whose primary occupation identified in the Express Entry system is,
i. NOC 31100 – Specialists in clinical and laboratory medicine,
ii. NOC 31101 – Specialists in surgery, or
iii. NOC 31102 – General practitioners and family physicians,
as listed in the National Occupational Classification, the applicant must have accumulated, within three years before the date of making the application and while lawfully residing and working in Canada, a cumulative period of at least one year of paid full-time work experience, or the equivalent paid part-time work experience as described in section 16, in one or more of those occupations, where the experience was accumulated during periods other than when the applicant was engaged in a full-time program of study.
4. Section 11 of the Regulation is amended by adding the following paragraph:
3.1 If the applicant is a member of the Canadian experience class whose primary occupation identified in the Express Entry system is,
i. NOC 31100 – Specialists in clinical and laboratory medicine,
ii. NOC 31101 – Specialists in surgery, or
iii. NOC 31102 – General practitioners and family physicians,
as listed in the National Occupational Classification, the applicant must have accumulated, within three years before the date of making the application and while lawfully residing and working in Canada, a cumulative period of at least one year of paid full-time work experience, or the equivalent paid part-time work experience as described in section 16, in one or more of those occupations, where the experience was accumulated during periods other than when the applicant was engaged in a full-time program of study.
Commencement
5. This Regulation comes into force on the day it is filed.
