Amending O. Reg. 750/21

(MINIMUM PRICING OF LIQUOR AND OTHER PRICING MATTERS)

1. The definitions of “Class A spirits”, “Class B spirits”, “Class C spirits” and “one pour cocktail” in subsection 1 (1) of Ontario Regulation 750/21 are revoked.

2. Section 3 of the Regulation is amended by adding the following subsection:

(3.1) Subsection (1) does not apply in respect of spirits.

3. Part III of the Regulation is revoked.

4. The title to Part IV of the Regulation is amended by striking out “CLASS C SPIRITS”.

5. Section 10 of the Regulation is amended by striking out “non-draft and draft cider, Class C spirits and wine cooler” in the portion before paragraph 1 and substituting “non-draft cider, draft cider and wine cooler”.

6. (1) Section 11 of the Regulation is amended by striking out “cider, Class C spirits and wine cooler” and substituting “cider and wine cooler”.

(2) Items 6 to 9 of the Table to section 11 of the Regulation are revoked.

7. (1) Subsection 19 (1) of the Regulation is amended by striking out “Class A spirits, Class B spirits, Class C spirits” and substituting “spirits”.

(2) Subsection 19 (2) of the Regulation is revoked and the following substituted:

(2) In setting a minimum retail price under subsection (1), the LCBO shall have regard to the minimum retail prices that apply to liquor to which Parts IV and V apply and to spirits, if any, and shall set a minimum retail price for the liquor consistent with the price then in effect, if any, for the class that the liquor most closely resembles.

8. This Regulation comes into force on the later of April 1, 2025 and the day this Regulation is filed.
