Amending O. Reg. 78/12

(GENERAL)

1. Ontario Regulation 78/12 is amended by striking out “the lottery subsidiary” wherever it appears and substituting in each case “iGaming Ontario”.

2. Subsection 3 (2) of the Regulation is revoked.

3. Subsection 4 (2) of the Regulation is revoked.

4. Subsection 5 (2) of the Regulation is revoked.

5. Subsection 9 (2) of the Regulation is revoked.

6. Subsection 10 (2) of the Regulation is revoked.

7. Subsections 12 (3) and (4) of the Regulation are revoked.

8. Clause (b) of the definition of “online lottery scheme” in subsection 13.1 (1) of the Regulation is revoked and the following substituted:

(b) as defined in section 2 of the iGaming Ontario Act, 2024.

9. Clause 15 (4) (a) of the Regulation is revoked and the following substituted:

(a) must be signed by a person authorized to sign on behalf of the employer;

10. Clause 16 (5) (a) of the Regulation is revoked and the following substituted:

(a) must be signed by a person authorized to sign on behalf of the employer;

11. (1) Subsection 21 (1) of the Regulation is revoked and the following substituted:

Prohibition re minors

(1) An item of identification that meets the following requirements is prescribed for the purposes of subsection 2 (2) of the Act:

1. It includes a photograph of the individual.

2. It states the individual’s date of birth.

3. It reasonably appears to have been issued by a government or the Liquor Control Board of Ontario.

(2) Clause 21 (2) (b) of the Regulation is revoked and the following substituted:

(b) on claiming a prize, the individual presents an item of identification prescribed by subsection (1) that indicates that the individual is at least 18 years of age, and there is no apparent reason to doubt the item’s authenticity or that it was issued to the individual producing it.

(3) Clauses 21 (3) (a) and (b) of the Regulation are revoked and the following substituted:

(a) at the point of sale, the individual purchasing the lottery ticket provides to the self-serve terminal an item of identification prescribed by subsection (1) that indicates that the individual is at least 18 years of age, and there is no apparent reason to doubt the item’s authenticity; and

(b) on claiming a prize, the individual presents an item of identification prescribed by subsection (1) that indicates that the individual is at least 18 years of age, and there is no apparent reason to doubt the item’s authenticity or that it was issued to the individual producing it.

(4) Subsection 21 (4) of the Regulation is amended by striking out “documentation” and substituting “item of identification”.

Commencement

12. (1) Except as provided in this section, this Regulation comes into force on the day it is filed.

(2) Sections 1 and 8 come into force on the later of the day section 28 of Schedule 9 to the Building Ontario For You Act (Budget Measures), 2024 comes into force and the day this Regulation is filed.
