General
Payments out of certain revenue
1. (1) The Corporation shall make the following payments out of the revenue it receives from all online lottery schemes and that it generates from its conduct and management of those schemes, in the following order of priority:
1. Payment of prizes and winnings to players.
2. Payment of the Corporation’s operating expenses.
3. Payment required to be made to the Alcohol and Gaming Commission of Ontario under subsection 12 (1) of the Alcohol and Gaming Commission of Ontario Act, 2019.
4. Payments required to be made by the Corporation under an agreement relating to the distribution of a portion of the Corporation’s revenues to First Nations in Ontario that is,
i. entered into by the Province of Ontario and representatives of First Nations in Ontario, and
ii. approved by the Lieutenant Governor in Council.
(2) After making the payments under subsection (1), the Corporation may make payments out of the remaining revenue described in that subsection for capital expenditures in relation to the Corporation’s conduct and management of online lottery schemes.
(3) After making the payments under subsection (1) and, if applicable, subsection (2), the Corporation shall pay the amount remaining from the revenue described in subsection (1) into the Consolidated Revenue Fund at such times and in such manner as the Minister of Finance may direct.
(4) The Minister shall publish any agreement described in paragraph 4 of subsection (1) that is entered into on or after the day this Regulation comes into force, and any amendments to it, on a Government of Ontario website.
Commencement
2. This Regulation comes into force on the later of the day section 28 of Schedule 9 to the Building Ontario For You Act (Budget Measures), 2024 comes into force and the day this Regulation is filed.
