ZONING ORDER - CITY OF MISSISSAUGA, REGIONAL MUNICIPALITY OF PEEL

Definition

1. In this Order,

“long-term care home” means a long-term care home defined in subsection 2 (1) of the Fixing Long-Term Care Act, 2021;

“zoning by-law” means Zoning By-law 0225-2007 of the City of Mississauga.

Application

2. (1) This Order applies to lands in the City of Mississauga, in the Regional Municipality of Peel, in the Province of Ontario, being the lands outlined on a map numbered 377 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

(2) Despite any future severance, partition or division of the lands described in subsection (1), this Order shall continue to apply to the lands as if no severance, partition or division occurred.

Non-application of s. 41 of the Act, site plan control area

3. Section 41 of the Act does not apply to the lands located in the area shown as Long-term Care Zone on the map referred to in subsection 2 (1).

Matters that may be dealt with in an agreement

4. Each person who owns all or part of the lands located in the area shown as Long-term Care Zone on the map referred to in subsection 2 (1) shall enter into one or more agreements with the City of Mississauga dealing with the matters listed in subsection 47 (4.4) of the Act.

Permitted uses

5. In addition to the uses permitted by the zoning by-law, the following uses are permitted on the lands located in the area shown as Long-term Care Zone on the map referred to in subsection 2 (1):

1. A long-term care home.

2. Accessory uses to the long-term care home.

Zoning requirements

6. (1) The zoning requirements that apply to the RA2 (Apartments) Zone pursuant to section 4.15 of the zoning by-law apply to the uses permitted under paragraphs 1 and 2 of section 5 of this Order, with the following additions and exceptions:

1. The maximum number of beds in a long-term care home is 128.

2. The maximum height of a long-term care home is five storeys and 22.0 metres.

3. A mechanical penthouse of a long-term care home is not considered a storey and may extend the height of a long-term care home to a maximum height of 26.0 metres.

4. The minimum interior side yard setback for a long-term care home is 4.5 metres.

5. The minimum above grade separation between buildings on the lands is 6.0 metres.

(2) Despite the zoning by-law, the following zoning requirements apply for any use of the lands described in subsection 2 (1):

1. The minimum landscaped area is 15 per cent.

2. The parking space requirements set out in Part 3 of the zoning by-law do not apply.

3. The bicycle parking space requirements set out in Part 3 of the zoning by-law do not apply.

Terms of use

7 (1) Every use of land and every erection, location and use of buildings or structures shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

8. This Order is deemed for all purposes, except for the purposes of section 24 of the Act, to be a by-law passed by the council of the City of Mississauga.

Commencement

9. This Regulation comes into force on the day it is filed.
