1. Section 144 of Ontario Regulation 746/21 is amended by adding the following subsections:
(3.1) Despite subparagraph 3 ii of subsection (3), the holder of a winery licence may sell, under a winery retail store endorsement,
(a) wine at a retail store located on a production site that was eligible to be sold at a retail store located on a different production site that used to be operated by the licensee; and
(b) wine that was transferred to the holder of the winery licence in accordance with section 144.1.
(3.2) Clause (3.1) (a) applies only if, before selling the wine, the holder of a winery licence gives written notice to the Registrar, within the time and in the form and manner specified by the Registrar, stating that the wine has been moved from the production site that used to be operated by the licensee to the current production site.
(3.3) Despite paragraph 4 of subsection (3), the holder of a winery licence may sell, under a winery retail store endorsement,
(a) sake at a retail store located on a production site that was eligible to be sold at a retail store located on a different production site that used to be operated by the licensee; and
(b) sake that was transferred to the holder of the winery licence in accordance with section 144.1.
(3.4) Clause (3.3) (a) applies only if, before selling the sake, the holder of a winery licence gives written notice to the Registrar, within the time and in the form and manner specified by the Registrar, stating that the sake has been moved from the production site that used to be operated by the licensee to the current production site.
2. The Regulation is amended by adding the following section:
Wine transfer
144.1 The holder of a winery licence may, under a winery retail store endorsement, transfer wine, including sake, to another holder of a winery licence if the following conditions are met:
1. The type of wine to be transferred is a type of wine that the Registrar has specified can be sold under the winery retail store endorsement held by the licensee receiving the wine under paragraph 1 of subsection 144 (3).
2. Both licensees are corporations with at least one shareholder in common.
3. The licensee transferring the wine holds a winery retail store endorsement for the production site from which the wine is transferred.
4. The wine to be transferred was eligible to be sold under the winery retail store endorsement at the retail store located on the production site of the licensee transferring the wine.
5. The licensee transferring the wine has submitted a request to the Registrar to cancel the manufacturer’s licence to sell.
6. Before the wine is transferred, the licensee transferring the wine gives written notice of the transfer to the Registrar within the time and in the form and manner specified by the Registrar.
7. No remuneration shall be provided for the transferred wine.
8. The licence of either licensee is not under suspension and no proposal to revoke or suspend either licence has been issued.
Commencement
3. This Regulation comes into force on the day it is filed.
