(AMOUNT PAYABLE BY MUNICIPALITIES FOR POLICING FROM ONTARIO PROVINCIAL POLICE)
1. Subclause (b) (i) of the definition of “number of properties” in subsection 1 (1) of Ontario Regulation 413/23 is revoked and the following substituted:
(i) is included in the commercial classes or the industrial classes, as defined in subsection 308 (1) of the Municipal Act, 2001 or the aggregate extraction property class prescribed under the Assessment Act, and
2. (1) Section 4 of the Regulation is amended by striking out “5 and 6” and substituting “4.1, 5 and 6” in the portion before paragraph 1.
(2) Paragraph 25 of section 4 of the Regulation is amended by adding “Subject to paragraph 25.1” at the beginning.
(3) Section 4 of the Regulation is amended by adding the following paragraph:
25.1 For the target year 2026 and subsequent target years, if the ratio of a municipality, as determined under paragraph 23, exceeds the average ratio, as determined under paragraph 24, by three or more standard deviations, determine the Municipal Calls for Service Charge for that municipality for the target year as follows:
i. Multiply the Municipal Calls for Service Charge for that municipality for the target year, as determined under paragraph 22, by the percentage set out in Column 3 of Table 2 opposite the number of standard deviations set out in Column 2 by which that municipality’s ratio exceeds the average ratio.
ii. Subtract the result obtained under subparagraph i from the Municipal Calls for Service Charge for that municipality for the target year, as determined under paragraph 22.
(4) Paragraph 34 of section 4 of the Regulation is amended by adding “Subject to paragraph 34.1” at the beginning.
(5) Section 4 of the Regulation is amended by adding the following paragraph:
34.1 For the target year 2026 and subsequent target years, if the ratio of a municipality, as determined under paragraph 23, exceeds the average ratio, as determined under paragraph 24, by three or more standard deviations, determine the Overtime Charge for that municipality for the target year as follows:
i. Multiply the Overtime Charge for that municipality for the target year, as determined under paragraph 33, by the percentage set out in Column 3 of Table 2 opposite the number of standard deviations set out in Column 2 by which that municipality’s ratio exceeds the average ratio.
ii. Subtract the result obtained under subparagraph i from the Overtime Charge for that municipality for the target year, as determined under paragraph 33.
(6) Subparagraph 35 ii of section 4 of the Regulation is amended by striking out “22 or 25” and substituting “22, 25 or 25.1”.
(7) Subparagraph 35 vii of section 4 of the Regulation is amended by striking out “33 or 34” and substituting “33, 34 or 34.1”.
3. The Regulation is amended by adding the following section:
Special rule, 2026
4.1 (1) The amount that each municipality must pay the Minister of Finance pursuant to subsection 64 (1) of the Act for policing provided by the Commissioner under the Act during the 2026 target year and for any reconciliation under section 10 with respect to policing services described in subsection (2) for the 2024 target year is the lesser of “X” or “Y” where,
“X” is the total of the amount determined under paragraph 35 of section 4 for the 2026 target year, plus or minus any amount that is,
(i) subtracted from the monthly accounts under clause 10 (2) (a) for policing provided pursuant to clause 57 (a) of the Act for the target year 2024 or for police services provided under the Police Services Act for the target year 2024, not including any police services that were identified as enhancements in agreements made under section 10 of the Police Services Act, as it read at the time, or
(ii) added to the monthly accounts under clause 10 (3) (a) for policing provided pursuant to clause 57 (a) of the Act for the target year 2024 or for police services provided under the Police Services Act, not including any police services that were identified as enhancements in agreements made under section 10 of the Police Services Act, as it read at the time, and
“Y” is 111 per cent of,
(i) the total of the 2025 monthly accounts sent to the municipality under section 9 excluding,
(A) any amount that the municipality owed for any services provided pursuant to an agreement made under subsection 17 (2) of the Act for the 2025 target year, and
(B) any amount that is,
(1) subtracted from the monthly accounts under clause 11 (2) (a) for the provision of police services that were identified as enhancements in an agreement made under section 10 of the Police Services Act, as it read at the time, for the 2023 target year, or
(2) added to the monthly accounts under clause 11 (3) (a) for the provision of police services that were identified as enhancements in an agreement made under the Police Services Act, as it read at the time, for the 2023 target year.
(2) The services mentioned in subsection (1) are policing provided pursuant to clause 57 (a) of the Act for the target year 2024 or police services provided under the Police Services Act for the target year 2024, not including any police services that were identified as enhancements in agreements made under section 10 of the Police Services Act, as it read at the time.
4. Section 10 of the Regulation is amended by adding the following subsections:
(5) Despite the definition of “number of properties” in subsection 1 (1) as it read immediately before section 1 of Ontario Regulation 224/25 made under the Act came into force,
(a) for the purpose of performing calculations under this section for the target year 2024, the number of properties shall include properties included in the subclass for property used for aggregate extraction prescribed for the industrial property class under the Assessment Act; and
(b) for the purpose of performing calculations under this section for the target year 2025, the number of properties shall include properties included in the aggregate extraction property class prescribed under the Assessment Act.
(6) For the purpose of conducting a reconciliation under this section for the target year 2024, clauses (2) (a) and (3) (a) only apply with respect to services provided pursuant to an agreement made under subsection 17 (2) of the Act or police services that were identified as enhancements in agreements made under section 10 of the Police Services Act, as it read at the time.
(7) For the purpose of performing calculations under this section, the actual amount owed by a municipality under this Regulation for the target year 2026 is the lesser of the value of “X” or “Y” in section 4.1, plus any amount that the municipality owes for any services provided in 2026 pursuant to an agreement made under subsection 17 (2) of the Act.

Commencement
6. This Regulation comes into force on the day it is filed.
