ZONING ORDER — CITY OF TORONTO

Definitions

1. In this Order,

“grade” means 113 metres Canadian Geodetic Datum;

“gross floor area” means the sum of the total area of each floor level of building, above and below the ground, measured from the exterior of the main wall of each floor level, reduced by the area in the building used for the following:

1. Parking, loading and bicycle parking below ground.

2. Required loading spaces at the ground level and required bicycle parking spaces at or above ground.

3. Storage rooms, washrooms, electrical rooms, utility rooms, mechanical rooms and ventilation rooms below ground.

4. Shower and change facilities for required bicycle parking spaces and bicycle maintenance facilities for those parking spaces.

5. Amenity space.

6. Elevator shafts.

7. Mechanical penthouse.

8. Exit stairwells in the building;

“height” means the vertical distance between grade and the highest point of a building or structure;

“parking space” means an area that has dimensions not less than 2.6 metres in width, 5.6 metres in length and 2 metres in height, and that is readily accessible at all times for the parking and removal of a motor vehicle without the necessity of moving another motor vehicle;

“zoning by-law” means Zoning By-law 569-2013 of the City of Toronto.

Application

2. This Order applies to lands in the City of Toronto, in the Province of Ontario, being lands outlined in red on a map numbered 381 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Non-application of policy statements, etc.

3. Policy statements issued under subsection 3 (1) of the Act, provincial plans and official plans do not apply in respect of a licence, permit, approval, permission or other matter required before a use permitted by this Order may be established on the lands described in section 2.

Applicable zoning by-law

4. (1) The former Township of Pickering (West Rouge) Zoning By-law No. 1978 does not apply to the lands described in section 2.

(2) The zoning-by law shall apply to the lands described in section 2, which shall be zoned Institutional General.

Permitted uses

5. Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for the following uses:

1. Nursing home.

2. Ancillary uses.

Zoning requirements

6. The zoning requirements for the uses permitted under section 5 are the following:

1. The total maximum gross floor area is 30,000 square metres.

2. Any part of a building or structure at or above grade is subject to the following setback requirements:

i. A minimum of 5 metres from the south lot line.

ii. A minimum of 12 metres from the west lot line.

iii A minimum of 14 metres from the north lot line.

iv. A minimum of 45 metres from the east lot line abutting East Avenue.

v. A minimum of 24 metres from the east lot line abutting 98 Island Road.

3. The following structures may encroach within the required minimum building setbacks set out in paragraph 2 by a maximum of 0.5 metres:

i. Eaves.

ii. Cornices.

iii. Roof overhangs.

iv. Lighting fixtures.

v. Pilasters.

vi. Chimney breasts.

vii. Bay windows.

viii. Window sills.

ix. Other architectural features.

4. The following structures may encroach within the required minimum building setbacks set out in paragraph 2 by a maximum of 3.5 metres:

i. Awnings.

ii. Canopies.

5. The following structure may encroach within the required minimum building setbacks set out in paragraph 2 by a maximum of 2.0 metres:

i. Balconies.

6. The following structures may encroach within the required minimum building setbacks set out in paragraph 2 with no maximum encroachment, provided they are no higher than 4.5 metres above grade:

i. Decks.

ii. Terraces.

7. The following structures may encroach within the required minimum building setbacks set out in paragraph 2 with no maximum encroachment, provided they are no higher than 3.5 metres above grade:

i. Pergolas.

ii. Trellises.

iii. Gazebos.

iv. Arbours.

v. Exterior stairways.

vi. Wheelchair ramps.

vii. Stairs.

viii. Exit stairs.

ix. Covered stairs.

x. Stair enclosures.

xi. Guardrails.

xii. Balustrades.

xiii. Safety railings.

xiv. Bollards.

xv. Fences.

xvi. Landscape elements.

xvii. Retaining walls.

8. The following structures may encroach within the required minimum building setbacks set out in paragraph 2 with no maximum encroachment, provided they are no higher than 7.5 metres above grade:

i. Transformers and associated stacks.

ii. Generators and associated stacks.

9. The maximum height of any portion of a building or structure shall be,

i. 35 metres within 60 metres of the south lot line, and

ii. 42 metres beyond 60 metres of the south lot line.

10. The projections associated with the following structures may exceed the maximum height set out in paragraph 9 by up to 2.5 metres:

i. Ornamental elements.

ii. Parapets.

iii. Guardrails.

iv. Safety railings.

v. Vents.

vi. Fences.

vii. Wind screens.

viii. Privacy screens.

ix. Access roof hatches.

x. Trellises.

xi. Outdoor furniture.

xii. Landscape elements, including green roofs.

xiii. Roof assemblies.

xiv. Terraces.

xv. Thermal insulation.

xvi. Roof ballasts.

xvii. Skylights.

11. The following projections associated with the following structures may exceed the maximum height set out in paragraph 9 by up to 6 metres:

i. Mechanical penthouses.

ii. Elevator overruns.

iii. Stairs.

iv. Stair enclosures.

v. Cooling towers.

vi. Mechanical fans.

vii. Flues.

viii. Chimneys.

ix. Stacks.

x. A fence, wall or structure enclosing the projections described in subparagraphs v to ix.

12. Despite paragraph 9, window washing equipment, lightning rods and antennas are not limited to a maximum vertical projection.

13. A minimum of 20 per cent of the area of the lot not covered by buildings or structures must be soft landscaping.

14. A minimum of 128 parking spaces shall be provided.

15. A minimum of 12 bicycle parking spaces shall be provided, indoors or outdoors, composed of the following:

i. Four long-term bicycle parking spaces.

ii. Eight short-term bicycle parking spaces.

16. A minimum of one Type “G”, one Type “B” and two Type “C” loading spaces shall be provided.

17. Loading spaces may be located in any yard.

Terms of use

7. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

8. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the City of Toronto.

Commencement

9. This Regulation comes into force on the day it is filed.
