Transition of Boards Under Review or Supervision

Definitions

1. In this Regulation,

“board under supervision” means any board that, on the specified date, was subject to a vesting order made under subsection 257.31 (2) of the Act, as it read on that date; (“conseil sous supervision”)

“specified date” means the day before the Supporting Children and Students Act, 2025 received Royal Assent. (“date indiquée”)

Near North District School Board urgent review

2. (1) The urgent review of the Near North District School Board under Part III of Ontario Regulation 43/10 (Provincial Interest in Education) made under the Act is deemed to be an investigation directed by the Minister under section 230.1 of the Act about matters of public interest, and for the purposes of the investigation,

(a) the person appointed under subsection 16 (2) of Ontario Regulation 43/10 to conduct the urgent review is deemed to be an investigator appointed under subsection 230.1 (2) of the Act;

(b) the report submitted to the Minister as required by subsection 18 (2) of Ontario Regulation 43/10 by the person appointed under subsection 16 (2) of that Regulation is deemed to be a report submitted to the Minister under subsection 230.1 (5) of the Act; and

(c) directions or requirements issued under subsection 19 (1) of Ontario Regulation 43/10 are deemed to be directions made under section 230.2 of the Act.

(2) Despite subsection (1), subsections 230.1 (3), (4) and (6) of the Act do not apply to the investigation.

Boards under supervision

3. A board under supervision is deemed to be subject to a vesting order made pursuant to subsection 230.3 (1) of the Act and for the purposes of the vesting order,

(a) the requirement in subsection 230.3 (3) of the Act to transmit the vesting order to the secretary of the board does not apply;

(b) a notice published in the Ontario Gazette under clause 257.32 (1) (a) of the Act, as it read on the specified date, is deemed to be a notice published under subsection 230.4 (1) of the Act;

(c) leave granted by the Minister to commence or continue a proceeding against the board under clause 257.32 (2) (a) of the Act, as it read on the specified date, is deemed to be leave granted by the Minister under clause 230.4 (2) (a) of the Act;

(d) leave granted by the Minister to enforce an order of any court against the board under clause 257.32 (2) (b) of the Act, as it read on the specified date, is deemed to be leave granted by the Minister under clause 230.4 (2) (b) of the Act; and

(e) any person appointed by the Minister under subsection 257.48 (2) of the Act, as it read on the specified date, is deemed to be a person appointed under subsection 230.15 (2) of the Act.

Commencement

4. This Regulation comes into force on the day it is filed.
