Amending O. Reg. 245/97

(EXPLORATION, DRILLING AND PRODUCTION)

1. Section 20 of Ontario Regulation 245/97 is amended by adding the following subsections:

(5) For the purposes of subsection (6), a carbon storage protection area is an area identified as such on a map that,

(a) is attached to a research and evaluation permit or a storage permit that,

(i) is issued under the Geologic Carbon Storage Act, 2025 in relation to a carbon storage site, as defined in that Act, located within that area, and

(ii) authorizes the storage of carbon dioxide or other substances in a storage repository; and

(b) is made available to the public on a website maintained by the government of Ontario.

(6) No person shall complete, service or otherwise perform work of any kind on a well within a carbon storage protection area if the performance of such work will or is likely to fracture or result in communication with any subsurface geological system that forms part of the area used for the carbon storage site, including confining units and the geological stratum or strata into which carbon dioxide is injected or within which it is contained for the purpose of geologic storage.

Commencement

2. This Regulation comes into force on the later of the day subsection 4 (1) of Schedule 2 (Geologic Carbon Storage Act, 2025) to the Resource Management and Safety Act, 2025 comes into force and the day this Regulation is filed.
