Amending O. Reg. 215/23

(GENERAL)

1. Subsection 1 (1) of Ontario Regulation 215/23 is amended by adding the following definitions:

“dentist” means a member of the Royal College of Dental Surgeons of Ontario or a person who is exempted from subsections 9 (1) and (2) of the Dentistry Act, 1991 by a regulation made under that Act; (“dentiste”)

“optometrist” means a person who is a member of the College of Optometrists of Ontario or a person who is exempted from subsections 9 (1) and (2) of the Optometry Act, 1991 by a regulation made under that Act; (“optométriste”)

“out of province physician” means a person who is exempted from subsections 9 (1) and (3) of the Medicine Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration authorizing independent practice in Ontario; (“médecin hors province”)

2. Section 15 of the Regulation is amended by adding the following subsection:

(2.1) Paragraphs 2 to 4 of subsection (2) do not apply if the physician is an out of province physician.

3. Section 16 of the Regulation is amended by adding the following subsections:

(2.1) Clause (2) (d) does not apply if the attending physician is an out of province physician.

(2.2) Clause (2) (e) does not apply if the referring physician is an out of province physician.

Commencement

4. This Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.
