Transitional Matters

Payment of holdback

1. (1) In this section,

“transition day” means the day section 26 of Schedule 4 to the Building Ontario For You Act (Budget Measures), 2024 comes into force.

(2) If, before the transition day, the payer was permitted to make payment of a holdback on an annual basis or on a phased basis under section 26.1 or 26.2 of the Act, as it read before its repeal, that section continues to apply with respect to the payment of the holdback until the day specified in paragraph 1 of subsection 87.4 (4) of the Act.

(3) Subsection (2) applies with necessary modifications with respect to the project agreements prescribed under section 2.

(4) For the purposes of subsections 87.4 (4) and (5) of the Act, section 26 of the Act, as it read before the transition day, applies without reference to section 27.1 of the Act.

Prescribed project agreements

2. The project agreements listed in Schedule 1 are prescribed for the purposes of subsection 87.4 (5) of the Act.

Commencement

3. This Regulation comes into force on the later of the day subsection 8 (2) of Schedule 2 to the Fighting Delays, Building Faster Act, 2025 comes into force and the day this Regulation is filed.

5. Project Agreement for the Ontario Line Subway Rolling Stock, Systems, Operations and Maintenance Project, entered into by Metrolinx and Connect 6ix General Partnership on November 15, 2022.

6. Project Agreement to Design, Build And Finance Ontario Line — Southern Civil, Stations And Tunnel Project, entered into by Metrolinx and Ontario Transit Group Inc. on November 8, 2022.

7. Project Agreement for South Niagara Hospital P3 DBFM Project, entered into by Niagara Health System and EllisDon Infrastructure SNH General Partnership on February 16, 2023.

8. Project Agreement to Build and Finance Trillium Health Partners Broader Redevelopment (Queensway Health Centre) Project, entered into by Trillium Health Partners and EllisDon Infrastructure THPQ Inc. on February 8, 2024.
