Amending O. Reg. 197/96

(CONSENT APPLICATIONS)

1. Ontario Regulation 197/96 is amended by adding the following section:

Prescribed profession (s. 53 (4.0.1) of the Act)

2.1 For the purposes of subsection 53 (4.0.1) of the Act, professional engineering is a prescribed profession.

2. (1) Paragraphs 1 and 2 of subsection 9 (1) of the Regulation are revoked and the following substituted:

1. If the certificate is affixed to a deed or other document relating to the transaction in respect of which the consent has been given, a stamp that states the following:

CERTIFICATE OF OFFICIAL

Planning Act

Under subsection 53 (42) of the Planning Act, I hereby certify that the consent of the (name of the approval authority) was given on (date) to the transaction to which this instrument relates.

2. In all other cases, a certificate that states the following:

CERTIFICATE OF OFFICIAL

Planning Act

Under subsection 53 (42) of the Planning Act, I certify that the consent of the (name of the approval authority) was given on (date) to a (type of transaction, i.e., conveyance, mortgage, etc.) of the following land (full description of land that is the subject of the consent).

(2) Paragraphs 1 and 2 of subsection 9 (2) of the Regulation are revoked and the following substituted:

1. If it is affixed to a deed or other document relating to the transaction in respect of which the consent has been given, a stamp that states the following:

CERTIFICATE OF OFFICIAL

Planning Act

Under subsection 53 (42) of the Planning Act, I certify that the consent of the (name of the approval authority) was given on (date) to the transaction to which this instrument relates.

Subsection (subsection 50 (3) or (5), as the case may be) of the Planning Act applies to any subsequent conveyance of or transaction involving the parcel of land that is the subject of this consent.

2. In all other cases, a certificate that states the following:

CERTIFICATE OF OFFICIAL

Planning Act

Under subsection 53 (42) of the Planning Act, I certify that the consent of the (name of the approval authority) was given on (date) to a (type of transaction, i.e., conveyance, mortgage, etc.) of the following land (full description of land that is the subject of the consent).

Subsection (subsection 50 (3) or (5), as the case may be) of the Planning Act applies to any subsequent conveyance of or transaction involving the parcel of land that is the subject of this consent.

3. Forms 1, 2, 3 and 4 of the Regulation are revoked.

Commencement

4. This Regulation comes into force on the day it is filed.
