Amending O. Reg. 194/24

(ZONING ORDER — ONTARIO PLACE)

1. Subsection 1 (1) of Ontario Regulation 194/24 is amended by adding the following definitions:

“Martin Goodman Trail” means the publicly accessible open space known as the Martin Goodman Trail;

“public parking garage” means a building or a portion thereof, with one or more parking spaces used for the purpose of public parking or parking ancillary to a permitted use on the Blocks, where such building or a portion thereof may also include bicycle parking spaces;

2. (1) Subsection 5 (2) of the Regulation is amended by adding the following paragraphs:

5. Public parking garage.

6. Artist studio.

7. Custom workshop.

8. Education uses.

(2) Subsection 5 (5) of the Regulation is amended by striking out “the uses set out in subsections (1) to (4)” and substituting “a use set out in this section or subsection 5.1 (1)”.

3. Subsection 5.1 (1) of the Regulation is amended by adding the following paragraph:

7. Publicly accessible open space.

4. (1) Subparagraph 1 viii of subsection 6 (2) of the Regulation is revoked and the following substituted:

viii. Section 200.15.

(2) Paragraph 9 of subsection 6 (2) of the Regulation is amended by striking out “5 per cent” and substituting “10 per cent”.

(3) Subparagraph 13 iv of subsection 6 (2) of the Regulation is revoked.

(4) Subparagraph 13 v of subsection 6 (2) of the Regulation is amended by striking out “with regulations referred to in subparagraph iv” and substituting “with the requirements set out in paragraphs 10, 11 and 12”.

(5) Paragraphs 4 and 5 of subsection 6 (3) of the Regulation are revoked and the following substituted:

4. Paragraphs 2 and 3 do not limit the permitted gross floor area of premises used for a community centre, washroom, play structure or other recreational facility, an enclosed pedestrian and vehicular bridge, museum, education use, artist studio, custom workshop, public parking, public parking garage or marina, as well as ancillary uses, including but not limited to ancillary eating establishments.

5. Any building or structure on the Block 1 mainland must have a minimum setback of 2.0 metres from the Martin Goodman Trail, excluding the following:

i. Public parking garages.

ii. Structures associated with traffic control, including but not limited to traffic signals, gates and barriers.

iii. Structures in support of active transportation, including but not limited to pedestrian and bicycle bridges, overpasses, ramps, stairs and elevators, which structures may be enclosed or unenclosed.

(6) Paragraphs 5 and 6 of subsection 6 (4) of the Regulation are revoked and the following substituted:

5. A building on the Block 2 mainland must be set back a minimum of 6 metres from the Martin Goodman Trail, with the exception that the portions of a building above a height of 9 metres as measured from the Canadian Geodetic Datum elevation of 76.5 metres are not required to be set back from the Martin Goodman Trail, provided that, above a height of 9 metres, the total horizontal length of main walls fronting onto Lake Shore Boulevard West do not exceed 50 per cent of the total horizontal length of Block 2 abutting Lake Shore Boulevard West.

6. Any building or structure on the Block 2 mainland must be set back a minimum of 58 metres from the eastern limit of Block 4, with the exception of the first storey of a building which must be set back a minimum of 70 metres from the eastern limit of Block 4, where the first storey is the level of a building closest to the finished ground surface abutting the building and where the midpoint between the lowest part of a floor and the ceiling directly above it is above the level of the finished ground.

(7) Paragraph 7 of subsection 6 (4) of the Regulation is amended by striking out “building setback” and substituting “setbacks”.

(8) Paragraph 7 of subsection 6 (4) of the Regulation is amended by adding the following subparagraph:

xvi. Structures associated with traffic control, including but not limited to traffic signals, gates and barriers.

5. This Regulation comes into force on the day it is filed.
