Amending O. Reg. 318/18

(ADMINISTRATIVE PENALTIES — GENERAL)

1. Section 1 of Ontario Regulation 318/18 is revoked and the following substituted:

Interpretation

1. (1) In this Regulation,

“order” means an order made under subsection 30 (1) of the Act; (“ordonnance”)

“prescribed provision” means a provision of the Act set out in Column 1 of Schedule 1 to this Regulation. (“disposition prescrite”)

(2) The contravention of each prescribed provision is classified as minor, moderate or major as indicated opposite the prescribed provision in Column 2 of Schedule 1 to this Regulation.

Amount of administrative penalties

1.1. (1) For the purposes of this section, the base amount of an administrative penalty for a contravention of a prescribed provision by a ticket business is,

(a) if the contravention of the prescribed provision constitutes a minor contravention,

(i) $300, in the case of a ticket business that is not a corporation, and

(ii) $3,000, in the case of a ticket business that is a corporation;

(b) if the contravention of the prescribed provision constitutes a moderate contravention,

(i) $500, in the case of a ticket business that is not a corporation, and

(ii) $5,000, in the case of a ticket business that is a corporation; and

(c) if the contravention of the prescribed provision constitutes a major contravention,

(i) $1,000, in the case of a ticket business that is not a corporation, and

(ii) $10,000, in the case of a ticket business that is a corporation.

(2) For the purposes of subsection 30 (3) of the Act, the amount of an administrative penalty for a contravention of a prescribed provision is,

(a) in the case of a first order issued against the ticket business for a contravention of the prescribed provision, the base amount;

(b) in the case of a second order issued against the ticket business for a contravention of the prescribed provision, one and half times the base amount; and

(c) in the case of a third or subsequent order issued against the ticket business for a contravention of the prescribed provision, two and a half times the base amount.

(3) If 24 months have elapsed without an order having been issued against a ticket business for the contravention of a prescribed provision, any previous order issued against the ticket business for a contravention of the prescribed provision shall not be taken into account for the purposes of subsection (2).

2. (1) Subsection 2 (1) of the Regulation is amended by striking out “one provision listed in any of the items of Column 1 of Table 1” and substituting “prescribed provision”.

(2) Subsection 2 (2) of the Regulation is amended by striking out “provision listed in any of the items of Column 1 of Table 1” and substituting “prescribed provision”.

3. The Regulation is amended by adding the following Schedule:

Commencement

4. This Regulation comes into force on the later of the day section 9 of Schedule 58 to the Protecting What Matters Most Act (Budget Measures), 2019 comes into force and the day this Regulation is filed.
