(LICENSING)
1. Subsections 84 (1) and (2) of Ontario Regulation 746/21 are revoked and the following substituted:
Financial relationships
(1) The licensee shall not offer private label liquor for sale at the grocery store or convenience store.
(2) For the purposes of subsection (1), liquor is private label liquor in relation to the licensee if,
(a) the liquor is of a brand in which the licensee or any affiliate of the licensee has a direct or indirect financial interest; or
(b) the liquor is of a brand that is marketed under a trademark in which the licensee or any affiliate of the licensee has a direct or indirect financial interest.
(2.1) The licensee shall not enter into an exclusive label arrangement.
(2.2) For the purposes of subsection (2.1), an exclusive label arrangement is an arrangement between the licensee and a liquor manufacturer that restricts the liquor manufacturer’s ability to sell its liquor in stores not owned or operated by the licensee.
2. The French version of subsection 138 (2) of the Regulation is amended by striking out “les conditions suivantes” at the end of the portion before paragraph 1 and substituting “l’une ou l’autre des conditions suivantes”.
