Amending Reg. 347 of R.R.O. 1990

(GENERAL - WASTE MANAGEMENT)

1. Subsection 1 (1) of Regulation 347 of the Revised Regulations of Ontario, 1990 is amended by adding the following definition:

“renewable biogas upgrading facility” means a facility producing renewable natural gas for immediate injection into natural gas infrastructure by upgrading landfill gas or gaseous fuel from anaerobic digestion that the facility received through a pipeline from a landfill site or an anaerobic digestion facility located at a different site;

2. Subsection 3 (2) of the Regulation is amended by adding the following paragraph:

26.  Compost generated at a waste disposal site described in section 7.1.

3. The Regulation is amended by adding the following sections:

7.1 Subsection 27 (1) of the Act does not apply to a waste disposal site established for composting organic waste generated from a community garden, allotment garden, community kitchen or school if,

(a)  the waste disposal site receives no more than 750 kilograms of organic material per week;

(b)  the waste disposal site has a total capacity of no more than 39,000 kilograms of organic material;

(c)  the waste disposal site receives only plant-based organic material, paper cardboard, clean woodchips, yard wastes and eggshells and does not receive grass clippings;

(d)  the compost generated on site is not sold;

(e)  the waste disposal site is located at the community garden, allotment garden, community kitchen or school; and

(f)  the waste disposal site is managed in such a way as to control off-site environmental impacts, including odour, water contamination, dust, noise, vermin and vectors.

7.2 Subsection 27 (1) of the Act does not apply to a renewable biogas upgrading facility.

Commencement

4. This Regulation comes into force on the later of September 1, 2026 and the day this Regulation is filed.
