Amending O. Reg. 387/04

(WATER TAKING AND TRANSFER)

1. (1) Subsection 4 (2) of Ontario Regulation 387/04 is amended by adding “water” after “proposed” in the portion before paragraph 1.

(2) Subparagraph 2 iv of subsection 4 (2) of the Regulation is revoked and the following substituted:

iv.  any planned municipal use of water that,

A.  has been approved under a municipal official plan in accordance with Part III of the Planning Act,

B.  has been approved under the Environmental Assessment Act, or

C.  is or forms part of a Part II.4 project within the meaning of the Environmental Assessment Act and all of the requirements for commencing the project prescribed under that Act have been met.

(3) Subsection 4 (5) of the Regulation is amended by striking out “Environmental Bill of Rights” and substituting “Environmental Bill of Rights, 1993”.

2. Subsection 8 (1) of the Regulation is revoked.

3. Subsection 12 (1) of the Regulation is amended by striking out “Ministry of Natural Resources and Forestry” and substituting “Ministry of Natural Resources”.

4. Subsection 19 (5) of the Regulation is revoked.

5. The Regulation is amended by striking out “an order under Part II” wherever it appears and substituting in each case “an order under subsection 16 (1)”.

Commencement

6. This Regulation comes into force on the later of January 1, 2027 and the day this Regulation is filed.
