Amending Reg. 690 of R.R.O. 1990

(PROCEDURES AND RECORDS)

1. Regulation 690 of the Revised Regulations of Ontario, 1990 is amended by adding the following section:

Prescribed claims, cl. 59 (1) (g) of the Act

63.1 A claim to recover compensation out of The Land Titles Assurance Fund that meets the following criteria is prescribed for the purposes of clause 59 (1) (g) of the Act:

1. The claim is made by a chargee who has been wrongfully deprived of some estate or interest in land by reason of the registration of a fraudulent instrument.

2. An application referred to in subsection 57 (6) of the Act has not been made in relation to the claim before the day section 1 of Ontario Regulation 296/26 made under the Act came into force.

Commencement

2. This Regulation comes into force on the day it is filed.
