Amending O. Reg. 558/22

(ADMINISTRATIVE PENALTIES)

1. (1) Subsection 7 (1) of Ontario Regulation 558/22 is amended by striking out “Subject to subsections (2), (3) and (4)” at the beginning and substituting “Subject to subsection (4)”.

(2) Subsections 7 (2) and (3) of the Regulation are revoked and the following substituted:

(2) Subsections (2) and (3), as they read immediately before the day they were revoked by subsection 1 (2) of Ontario Regulation 316/26, continue to apply with respect to contraventions that occurred before that day.

(3) Subsection 7 (4) of the Regulation is amended by striking out “subsections (1), (2) and (3)” and substituting “subsection (1)”.

2. Section 12 of the Regulation is amended by adding the following subsection:

(3) Despite the amendments made to this Regulation by Ontario Regulation 316/26 and despite the amendments made to Ontario Regulation 225/18 (Tires) made under the Act by Ontario Regulation 311/26,

(a) an order may be issued on or after the day Ontario Regulation 316/26 comes into force in respect of a contravention of a provision set out in Column 1 of the Tables to Schedules 1 and 2 as they read before that day if the contravention occurred before that day; and

(b) the regulations in Column 1 as they read before that day continue to apply in respect of a contravention that occurred before that day.

3. (1) Item 2 of Table 2 to Schedule 1 to the Regulation is revoked.

(2) Table 2 to Schedule 1 to the Regulation is amended by adding the following item:

(3) Items 5 and 6 of Table 2 to Schedule 1 to the Regulation are revoked and the following substituted:

(4) Item 7 of Table 2 to Schedule 1 to the Regulation is amended by striking out “12 (2) in respect of the requirement under subsection 12 (9)” at the end of Column 1 and substituting “12 (13)”.

(5) Item 7 of Table 2 to Schedule 1 to the Regulation is amended by striking out “specified amount of tires is attributable to large tires as required under subsection 12 (9)” at the end of Column 2 and substituting “the activities referred to in subsection 12 (6) are undertaken”.

(6) Table 2 to Schedule 1 to the Regulation is amended by adding the following item:

4. (1) Item 1 of Table 2 to Schedule 2 to the Regulation is amended by striking out “10.1” wherever it appears and substituting in each case “10.2”.

(3) Item 17 of Table 4 to Schedule 2 to the Regulation is amended by striking out “Subsection 26 (1)” in Column 1 and substituting “Section 26”.

(4) Item 14 of Table 5 to Schedule 2 to the Regulation is amended by striking out “Subsection 52 (1)” in Column 1 and substituting “Section 52”.

Commencement

5. This Regulation comes into force on the day it is filed.
