Onus of proof of compliance with requirements as to fire escapes, etc.
1.Where, by a statute or municipal by-law, or by a regulation made under a statute or by-law, the owner, proprietor, lessee, occupant, manager or other person owning, occupying or having the control or management of a building is required to provide fire escapes, means of exit, stairways or other structures or any appliance for the safety of inmates or of the public in case of fire, and it is shown in an action brought against such person to recover damages for death occasioned by fire in such building that such requirements or any of them had not been complied with at the time of the fire, it shall be presumed that the non-compliance was the cause of the death.
