Firefighters Exemption Act

When firefighters to be exempted from serving as jurors and constables

1. Whenever a company of firefighters has been regularly enrolled in a municipality with the approval of the council of the municipality, the council shall direct the clerk to grant to each member of the company a certificate that he or she is enrolled in the company, which certificate exempts the person named therein, during the period of enrolment and continuance in actual duty, from serving as a juror or a constable. Forfeiting exemption after hearing

2. (1) Upon complaint to the council of neglect of duty by a member of such fire company, the council shall examine into the complaint and, for any such cause and also in case a member of the company is convicted of a breach of any of the rules legally made for the regulation of the company, may, after a hearing, strike off the name of any such member from the list of the company and thenceforward the certificate granted to the member has no effect in exempting him or her from any duty or service.

Parties to hearing

(2) The member of the fire company against whom the complaint has been made and the complainant, if any, are parties to a hearing under subsection (1). R.S.O. 1990, c. F.16, s. 2.
