Minors’ Protection Act

Supplying tobacco
1. (1) No person shall either directly or indirectly sell or give or furnish to a child under eighteen years of age cigarettes, cigars or tobacco in any form.
Exception
(2) This section does not apply to a sale to a child for his or her parent or guardian under a written request or order of the parent or guardian. R.S.O. 1980, c.293, s.1.
Offence
2. (1) Every person who contravenes any of the provisions of this Act is guilty of an offence and on conviction is liable to a fine of not less than $50 and not more than $500. R.S.O. 1980, c.293, s.2(1); 1989, c.72, s.13(1).
Idem, corporation
(2) Where a corporation is convicted of an offence under subsection (1), the minimum fine shall be $200 and the maximum fine $25,000. 1989, c.72, s.13(2).
Presumption as to age
(3) A person who appears to the court to be under eighteen years of age shall be deemed to be under that age unless it is found that he or she is in fact over that age. R.S.O. 1980, c.293, s.2(3).
