Conveyance of property for school sites to trustees

1 Where persons, residing in Ontario, interested in any school established in any local municipality therein whether as parents of children frequenting such schools or as contributors to the same, or both, have occasion or are desirous to take a conveyance of real property for the use of such schools, such persons may elect from among themselves, and appoint not fewer than five and not more than seven trustees, to whom and to whose successors, to be appointed in the manner specified in the deed of conveyance, the real property requisite for the school may be conveyed.  R.S.O. 1990, c. S.3, s. 1; 2002, c. 17, Sched. F, Table.

Powers of trustees to hold

2 (1)  The trustees so appointed and their successors in perpetual succession, by the name expressed in the deed, may take, hold and possess the real property so conveyed, and bring and maintain any action for the protection thereof, and of their right thereto, but there shall not be so held in trust more than ten acres of land at any time for any one school.  R.S.O. 1990, c. S.3, s. 2 (1).

Application of section

(2)  This section does not extend to public schools.  R.S.O. 1990, c. S.3, s. 2 (2).

Registration of deed

3 The trustees shall, within twelve months after the execution of any such deed, cause the deed to be registered in the land registry office of the registry division in which the land lies.  R.S.O. 1990, c. S.3, s. 3.
