Physician Services Delivery Management Act, 1996

Designation of rights and obligations

1. (1) For the purposes of this section, the Lieutenant Governor in Council may, by order,

(a) designate obligations of the Crown in right of Ontario, the Government of Ontario and ministers of the Crown; and

(b) designate rights of persons and associations who have entered into agreements with the Crown in right of Ontario, the Government of Ontario or ministers of the Crown. 1996, c. 1, Sched. I, s. 1 (1).

Application

(2) Subject to subsection (3), this section applies to the following rights and obligations:

1. A right or obligation under the following agreements between the Government of Ontario and the Ontario Medical Association,

i. the “1991 Framework Agreement” and the “1991 Interim Agreement on Economic Arrangements” executed by the Ontario Medical Association on May 4, 1991 and by the Government of Ontario on May 10, 1991,

ii. the Agreement entitled “Payment of Canadian Medical Protective Association Fund Premiums for 1989, 1990 and 1991 and of Dues to the OMA for representing Physicians” dated April 2, 1991,

iii. the “1993 Interim Agreement on Economic Arrangements” dated August 1, 1993,

iv. the “Physician Sectoral Agreement” dated August 1, 1993.

2. A right or obligation to engage in negotiation, mediation and arbitration on matters relating to a right or obligation under an agreement mentioned in paragraph 1.

3. A right or obligation under an agreement that refers to an agreement mentioned in paragraph 1. 1996, c. 1, Sched. I, s. 1 (2).

Effect

(3) A designated right or obligation is not enforceable, and no proceeding directly or indirectly based on it may be brought against a person or entity referred to in clause (1) (a). 1996, c. 1, Sched. I, s. 1 (3).

Decision of no effect

(4) If a right or obligation is designated under this Act, a decision, ruling, award or order made in a proceeding relating to a dispute about the right or obligation shall be of no force or effect. 1996, c. 1, Sched. I, s. 1 (4).

(5) Subsection (4) applies whether the decision, ruling, award or order is made before or after the date of the designation of the right or obligation. 1996, c. 1, Sched. I, s. 1 (5).
