EXEMPTIONS

Exemption from section 5 of Act

1. Section 5 of the Act does not apply with respect to the submission of a document to a Ministry of the Government of Ontario electronically if,

(a) an original signature is required on the document;

(b) the document must be submitted with a payment;

(c) the document cannot be submitted electronically because,

(i) the document is not in a format that meets the information technology requirements for electronic submission set by the Ministry in order to ensure that the document is accessible by the Ministry so as to be usable for subsequent reference and is capable of being retained by the Ministry, or

(ii) there is a disruption of normal operations that would prevent the Ministry from receiving or accessing the document so that it is usable for subsequent reference or from retaining it;

(d) the document is required to be submitted for the purpose of an inspection or investigation; or

(e) Revoked: O. Reg. 804/21, s. 1.

(f) the document is required to be submitted to the Ministry of Public and Business Service Delivery in order to comply with a regulation made under the,

(i) Bailiffs Act,

(ii) Boundaries Act,

(iii),(iv) Revoked: O. Reg. 76/24, s. 1 (3).

(v) Collection and Debt Settlement Services Act,

(vi) Condominium Act, 1998,

(vii),(viii) Revoked: O. Reg. 76/24, s. 1 (3).

(ix) Corporations Act,

(x),(xi) Revoked: O. Reg. 76/24, s. 1 (3).

(xii) Land Registration Reform Act,

(xiii) Land Titles Act, or

  (xiv),(xv) Revoked: O. Reg. 76/24, s. 1 (5).
