Amending O. Reg. 516/06
(GENERAL)
1. (1) Subsection 24 (1) of Ontario Regulation 516/06 is amended by adding the following clause:
(a.1) exclude, for an application filed on or after April 24, 2017, any amount paid by the landlord for carbon costs in respect of operating costs for heat provided by gas;
(2) Section 24 of the Regulation is amended by adding the following subsection:
(1.2) In determining the amount of operating costs for heat provided by gas in an application under section 126 of the Act that is filed before April 24, 2017, the Board shall include any amount paid by the landlord that is attributable to carbon costs.
(3) Subsection 24 (4) of the Regulation is amended by adding the following definition:
“carbon costs” means charges in respect of gas that a gas distributor provides to a landlord, where the charges are reflected in rates approved by the Ontario Energy Board and are attributable to the cost to the gas distributor of complying with the Climate Change Mitigation and Low-carbon Economy Act, 2016 and the regulations made under that Act; (“coûts carbone”).
Commencement
2. This Regulation comes into force on the day it is filed.
