Amending O. Reg. 367/11
(GENERAL)
1. Subsection 1 (1) of Ontario Regulation 367/11 is amended by adding the following definition:
“Ontario Basic Income Pilot” means the basic income pilot program administered by the Ministry of Community and Social Services; (“Projet pilote portant sur le revenu de base”)
2. (1) Section 30 of the Regulation is amended by adding “Subject to subsection (2)” at the beginning.
(2) Section 30 of the Regulation is amended by adding the following subsection:
(2) A household does not cease to be eligible under subsection (1) if the following conditions are met:
1. The household received payments under the Ontario Basic Income Pilot.
2. If the household had not received the payments referred to in paragraph 1, the amount of rent paid by the household would have been below what the rent would be if the household were not receiving rent-geared-to-income assistance.
3. Clause 34 (2) (b) of the Regulation is revoked and the following substituted:
(b) the income of the members of the household is the sum of all payments made to, on behalf of, or for the benefit of, the members other than,
(i) payments that are excluded under the local eligibility rule, and
(ii) payments made under the Ontario Basic Income Pilot.
4. Section 86 of the Regulation is amended by adding the following subsection:
(3) For the purposes of Schedule 5, payments received under the Ontario Basic Income Pilot shall not be included in the calculation of the annual income of a household.
5. (1) Subparagraph 4 ii of section 2 of Schedule 4.1 to the Regulation is amended by adding “Subject to subsection (2)” at the beginning.
(2) Section 2 of Schedule 4.1 to the Regulation is amended by adding the following subsection:
(2) A rule referred to in subpagragraph 4 ii of subsection (1) must provide that payments received under the Ontario Basic Income Pilot shall not be included in determining the income of the household.
(3) Paragraph 1 of subsection 3 (2) of Schedule 4.1 to the Regulation is amended by adding “Subject to subsection (2.1)” at the beginning.
(4) Section 3 of Schedule 4.1 to the Regulation is amended by adding the following subsection:
(2.1) A household does not cease to be eligible under paragraph 1 of subsection (2) if the following conditions are met:
1. The household received payments under the Ontario Basic Income Pilot.
2. If the household had not received the payments referred to in paragraph 1, the amount of the benefit payable in respect of the household would not have been an amount equal to zero.

6. This Regulation comes into force on the day it is filed.
